Additional Conditions

• Mandatory Conditions where the licence authorises the sale of alcohol

   

  1              No supply of alcohol may be made under the premise licence -

   

  (a) at a time when there is no designated premise supervisor in respect of the    licence , or

   

  (b) at a time when the designated premise supervisor does not hold a personal licence, or his licence has been suspended.

   

    2                             The supply of alcohol under a premises licence must be made or authorised by a      

  person who holds a personal licence.

   

  Irresponsible Drinks Promotions - Mandatory Conditions

   

  3.              (1)              The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

   

                              (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

                                            (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                                            (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

   

                              (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

                              (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

               (d)   selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

                              (e)  dispensing alcohol directly by one person into the mouth of another (other    than where that other person is unable to drink without assistance by reason of disability).

   

      

  4.              The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  Age Verification Policy - Mandatory Condition

   

  5.              (1)              The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

         (2)  The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

                (3)              The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

   

  (a)              a holographic mark, or

  (b)              an ultraviolet feature.

   

   

  Availability of different Measures - Mandatory Condition

   

  6.              The responsible person must ensure that:

   

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

   

                              (i)              beer or cider: ½ pint;

                              (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii)              still wine in a glass: 125 ml;

   

                (b)              these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

        (c)    where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

   

  Mandatory condition for the showing of films

  During the showing of films, the admission of children must be restricted in accordance with recommendations given either by a body designated under section 4 of the Video Recordings Act  1984 (the British Board of Film Classification - BBFC) or by the licensing authority.

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board.

   

   

  Alcohol Pricing

   

  1.              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  2.              For the purpose of the condition set out in paragraph 1-

   

  (a)              “duty” is to be construed in accordance with the Alcohol Liquor duties Act (1979)

  (b)              “permitted price” is the price found by applying the formula -

   

  P=D + (DxV)

                Where-

   

  (i)              P is the permitted price

  (ii)              D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c)              “relevant person” means, in relation to premises in respect of which there is in force a premise licence -

   

  (i)              The holder of the premise licence

  (ii)              The designated premise supervisor (if any) in respect of such a licence, or

  (iii)              The personal licence holder who makes or authorises a supply of alcohol under such a licence.   

   

  (d)              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question: and

   

  (e)              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994

   

  3.              Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4.              (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph (2) on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day

   

   

   

• Conditions on previous licence(s)

• Conditions consistent with Operating Schedule

   

  1        Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification are acceptable: UK photo driving licence, Passport, PASS card (proof of age standards scheme)

  2        Every member of staff undertaking the supply of alcohol must undertake written age awareness and responsible retailing training at the commencement of their employment aand re-fresh the same as least once a year. Records of training must be kept for inspection by Police or Local Authority.

  3        Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out to ensure that the premises are safe for use. Details of the inspection, defects discovered and remedial action taken shall be recorded in writing in a logbook kept for that purpose. That logbook shall be made available for inspection on demand to an Authorised Officer of the Council, a Fire Officer or a Police Constable.

  4        The fire alarm, emergency lighting system and electrical installation shall be tested on a regular basis, at a frequency determined by a competent person. Certificates should be issued showing the results of the tests. The certificates shall be made available for inspection on demand to an Authorised Officer of the Council, a Fire Officer or a Police Constable.

  5        Prior to any event which is to be held in the open air, tent, marquee or other non licensed area the Licensing Authority shall be given 10 working days notice to enable them, if they wish, to inspect the area(s) and make comment re public safety.

  6        At all times when the premises are used for the purpose of the premises licence, the licence holder, manager or designated premises supervisor who is responsible for the management of the premises shall at all times be aware of the number of persons on the premises and shall if requested to do so give that information to an authorised person.

  7        Theatre and Dance performances in the Nuffield Theatre and Playroom Studio occasionally contain language or images of an adult or sexual nature, semi-nudity or nudity.  The following safeguards are in place to deal with this: The Nuffield Director seeks to preview shows live or on video prior to booking.  We ask for a show description and age recommendation from the company prior to booking.  If the Nuffield Director deems the show and performing company as not suitable for those under the age of 18, tickets are only sold on presentation of valid ID.  Box Office warns all bookers of show content and advises if the show is suitable for children.  Trained Front of House staff warn public as they collect or buy tickets on the night of the performance.  We work closely with school and youth group parties to advise about content.

  7 At the Annual Student  Graduation Event, a number of temporary bars will be   assembled and used for the event. 14 days prior to the event the Designated Premises Supervisor will provide details of the locations to the Lancashire Police and Fire Services. This event will include the provision of recorded and live music, performance of dance, making music, provision of late night refreshment  and the sale of alcohol until 03.00am. There will be a minimum of one security person per 100 customers and security personnel for at least 30 minutes after the event closes.

  8.   For the annual June events there will be a minimum of one security person per 100 customers and security personnel will be present for at least 30 minutes after these events.

   

  All Licensed Premises selling alcohol operated by Lancaster University will adopt and abide by the policies detailed on the direction of University Council. The premises operate in a self contained university campus and subject to prescribed guidelines and the University has an excellent past record of controlling licensed premises.

   

  The Premises Licence Holder is Lancaster University Council with delegated responsibility to the University Secretary. Each College Bar will employ a Designated Premises Supervisor where possible and a suitable number of Personal Licence Holders to support the opening times and business cycle.

   

  Hospitality Division licensed premises will operate under one named Designated premises Supervisor and suitable number of Personal Licence Holders to support the opening times and business cycle.

   

  The Great Hall Complex licensed premises will operate under one named Designated premises Supervisor and suitable number of Personal Licence Holders to support the opening times and business cycle.

   

  General Statement

   

  1           The University Governing Body will hold all premises licences as a single licensee and recognises its responsibilities and obligations under the Licensing Act 2003.

  2           The Governing Body will implement policies relating to operating premises controlled by the University to meet the four key objectives of the Licensing Act 2003.

  3           All persons employed in licensed premises will, where possible, receive training commensurate with their responsibilities.

  4           An internal college student disciplinary procedure exists and meets the disciplinary objectives of the University.

  5           Incident logs are kept for recording events.

  6           24-hour security staff are in place on the University Campus.

  7           24 hour CCTV covers various public areas of the campus.

  8           There is a past record of good relationships with local residents and a liaison group with Galgate residents has existed for several years.

   

  Prevention of Crime and Disorder

   

   

  9           A designated Health and Safety Department is part of the university structure and is consulted on issues relating to public safety.

  10       Detailed risk assessments, as described in Section 12 of the Lancaster City Council Licensing Policy, have been carried out for all licensed premises.

  11       SIA registered door staff are used for the College Summer Extravaganzas and similar events, with a log of contractors and hours worked held by the DPS.

  12       Duty Managers attend events in Great Hall.

  13       Detailed risk assessments are in place for the College Summer Extravaganzas and similar events.

   

  Public Safety

   

  14       Regular fire safety inspections and drills are carried out.

  15       Plastic Glasses are used for external events.

  16       SIA registered door staff are used for larger events with a log of contractors and hours worked held by the DPS.

  17       Running drinking water is readily available for most events.

  18       An internal complaints procedure through college officers and student union is available.

   

  Prevention of Public Nuisance

   

  19       Premises display “leave quietly” notices.

  20       Dispersal - alcohol sales will cease at least 20 minutes from the terminal hour for the premises.

  21       Automatic noise limiters are used to control the maximum volume of amplified music if it is thought that the music may cause a nuisance when the music is played outdoors.

   

  Protection of Children from Harm

   

  22       Student I. D. cards are issued.

  23       Licensed bars clearly display Licensing for the sale of alcohol warning notices.

  24       Incident logs are kept for recording events.

  25       No alcohol will be served to anyone under the age of 18.

  26       Students who are under 18 years of age are made to known to Personal Licence Holders.

  27       The licensed premises do not contain gambling machines.

  28       A form of identification will be required by the barstaff if a customer looks under the age of 18 years. The only acceptable forms of identification will be passport, photo driving licence, proof of age scheme card.

   

  Lancaster University reserves the right to alter or amend or increase the above policies without notification.

   

• Non standard timings

   

  For one event a year within the month of June, namely the Annual Student Graduation Event, that the Great Hall Complex may be open till 03.30 am. .
