  On New Year’s Eve alcohol may be sold from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 hours (midnight) on 31st December).

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal

   

  Special Hours Certificate

  (1)               Subject to the following paragraphs, the permitted hours on weekdays shall extend until 02.00 hours in the morning following except that-

                (a)              the permitted hours shall end at 00.00 hours (midnight) on any day on which music and dancing is not provided after 00.00 hours (midnight); and

                (b)               on any day that music and dancing end between 00.00 hours (midnight) and 02.00 hours in the morning, the permitted hours shall end when the music and dancing end

   

  (2)              In relation to the morning on which summer time begins, paragraph (1) of this condition shall have effect with the substitution of references to 03.00 hours in the morning for references to 02.00 hours in the morning

   

  (3)              Except as provided in (4) below, the permitted hours on Sundays shall extend until 22.30 hours

   

  (4)              On Sundays immediately before bank holidays other than Easter Sunday, the permitted hours shall extend until 02.00 hours (in the morning) following except that-

                (a)               the permitted hours shall end at 00.00 hours (midnight) on any Sunday on which music and dancing is not provided after 00.00 hours (midnight);

                (b)               where music and dancing end between 00.00 hours (midnight) on any Sunday and 02.00 hours (in the morning), the permitted hours on that Sunday shall end when the music and dancing end

   

  (5)              The sale of alcohol must be ancillary to the use of the premises for music and dancing and substantial refreshment.

   

  NO Children’s Certificate

  No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:

  a)              He is the child of the holder of the premises licence.

  b)              He resides in the premises, but is not employed there.

  c)              He is in the bar solely for the purpose of passing to or from some part of the premises that is not a bar and to or from some part of the premises where there is no other convenient means of access or egress.

  d)              The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which holding of the licence is ancillary.

  In this condition “bar” includes any place exclusively or mainly used for the consumption of intoxicating liquor.  However, an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

   

  Mandatory conditions where licence authorises the supply of alcohol

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

  +

  1         The designated premises supervisor shall have at least 2 year’s experience of managing similar premises with a similar capacity and with a similar terminal hour

  2         A personal licence holder shall be on the premises at all times during which intoxicating liquor is being sold or supplied to customers or consumed by customers, except in the case of an emergency

  3         Whenever the designated premises supervisor is not at the premises another personal licence holder will be nominated by the designated premises supervisor as being the responsible person to manage the premises and will have the contact details of the designated premises supervisor. The details of such person to be on prominent display outside the premises

  4         A minimum number of 2 members of door staff registered with the SIA will be on duty from 15 minutes prior to the premises opening for the first 100 customers and thereafter one for every 100 customers or part thereof

  5         Two door supervisors registered with the SIA will remain outside the premises until at least 15 minutes after the last customer has left the premises

  6         Door supervisors registered with SIA shall be equipped with an appropriate method of keeping an accurate record of the capacity levels, including any separate capacity levels for individual rooms or levels

  7         Door supervisors shall be positioned at each entrance/exit (other than fire only exits) to ensure that no customer leaves with any bottles or glasses or food any container/or wrapper

  9         Two door supervisors will patrol the queue to the premises as necessary but no less than once every 5 minutes to ensure that customers who are drunk or who have acted in a disorderly manner, or have behaved in such a way as to cause a public nuisance or disturbance, are prevented from entering the premises

  10     The designated premises supervisor/premises licence holder will maintain a daily record comprising of the following: - Start time and finish time of each door supervisor. The door supervisor will record their SIA badge number and will sign and print their name in a legible form at the beginning and end of each tour of duty. The record shall be kept securely on the premises for at least 6 months and shall be produced on request to the police or other authorised person

  11     A crime prevention survey is to be carried out by the police and their recommendations fully complied with by the premises licence holder prior to the premises opening/the variation taking effect

  12     A risk assessment will be carried out by a suitably qualified person on behalf of the holder of the premises licence/club premises certificate relevant to crime and disorder, public safety, capacity and public nuisance and a copy of which shall be forwarded to the police.  For a temporary event notice the assessment should be limited to crime and disorder issues and a copy forwarded to the police

  13     To install, maintain and operate a CCTV system, which complies with the minimum requirements, expected of the Lancashire Constabulary and shall record during all hours that a licensable activity takes place on the premises

  14     A dispersal policy shall only be implemented if Walkabout apply for the same last sale and closing time

  15     Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18.  The following are the only forms of identification acceptable: UK photo driving licence; Passport; PASS card (proof of age standards scheme)

  16     The maximum number of persons (including staff) allowed to be on premises at any time shall be 650

  17     The premises licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend meetings of any pubwatch scheme for the area within which the premises are located and would include registration and use of community/network radio

  18     The premises licence holder will provide to the police a drugs policy for the premises which shall as a minimum contain all of the best practices outlined in the guidance published by the Home Office and the London Drug Policy Forum ‘Safer Clubbing’

  19     Free drinking water to be made available at all times from the bar

  20     No entry to or re-entry to the premises after 01.30 hours by members of the public or by any guests or friends of members of staff or the premises licence holder

  There will be no persons under the age of 18 years permitted on the premises
