  On New Year’s Eve alcohol may be sold from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 hours (midnight) on 31st December)

   

  An additional hour to the standard times on the day when British Summertime commences.

   

  Mandatory conditions where licence authorises the supply of alcohol

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  (3)              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children:

   

                              (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to:

   

                                            (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                                            (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

   

                              (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

                              (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

                              (d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

   

                                            (i)              the outcome of a race, competition or other event or process, or

   

                                            (ii)              the likelihood of anything occurring or not occurring

   

                              (e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  (4).              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  (5).              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  (6).              (1)              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

                (2)              The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  (7).              The responsible person shall ensure that:

   

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

   

                              (i)              beer or cider: ½ pint;

                              (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii)              still wine in a glass: 125 ml; and

   

                (b)              customers are made aware of the availability of these measures.

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

• Conditions consistent with the Operating Schedule

   

  All members of management and staff will be trained in all aspects of Licensing objectives as below.

   

  The prevention of crime and disorder

   

  A personal licence holder shall be on the premises at all times during which intoxicating liquor is being sold or supplied to customers or consumed by customers, except in the case of an emergency.

   

  The DPS must be on site every Friday and Saturday evening from 21:00 hours until the premises closes to the public or, alternatively, the DPS must nominate another personal alcohol licence holder to act in his or her place.

   

  By no later than 1st March 2012, CCTV shall be installed and operational at the premises.

  Said CCTV system shall record during all hours that a licensable activity takes place on the premises and be of such quality so as to provide facial images of persons inside the venue. CCTV recordings should be kept for a minimum of 28 days and staff should be able to operate the system to provide footage to police upon request.

   

  As a bare minimum, CCTV must be positioned so as to capture a head and shoulders image of each member of the public who enters the premises.

   

  A minimum number of 2 members of door staff registered with SIA will be on duty from 22:00 hours until closing time every Friday and Saturday night.

   

  Aminimum number of 2 members of door staff, registered with SIA, will be on duty from 22:00 hours until closing time on New Year's Eve.

   

  The designated premises supervisor must maintain an incident book comprising of the start time and finish time of each door supervisor. The door supervisor will record their SIA badge number and will sign and print their name in a legible form at the beginning and end of each tour of duty. The record shall detail incidents occuring at the venue and be kept securely on the premises for at least 6 months and shall be produced upon request to the police or other authorised person.

   

  A zero tolerance approach to drugs will be promoted via appropriate signage in the premises. Any person found to be in possession of drugs must be reported to the police immediately upon being apprehended.

   

  The premises must use Community Radio network (where reasonably available) and a working handset must be available at all times, except emergencies.

   

  Prevention of Public Nuisance

   

  There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or member and their guests) notices requiring customers to leave the premises and the area quietly.

   

  Refuse such as bottles shall be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.

   

  No glasses or open vessel to be taken from the venue or be permitted outside the venue.

   

  The provision of off-sales to terminate at 23.00 hours.

   

  Public safety

   

  Whilst in use the dance floor shall be supervised by a member of staff.

  The dance floor will be clearly marked so that it is easily identifiable to customers and members of staff.

  No drinks shall be taken onto the dance floor whilst it is in use.

   

  The protection of children from harm

   

  Any person who looks or appears to be under the age of 25 shall be asked to provide identification to evidence that they are over the age of 18. The following are the only forms of identification acceptable:-

   

                       Photo driving licence

                       Passport

                       PASS card

                       Any other form of identification agreed with representatives of Lancaster Police's Licensing Unit

   

  Signs should be prominently displayed at all public entrances and at the main bar advising patrons of the Challenge 25 policy.

   

  All staff who are involved in the sales of alcohol will be trained in relation to the Challenge 25 Policy prior to commencing their employment and shall also complete refresher training at least once every three months. Said training shall be documented and made available to an authorised officer upon request.

   

  All staff shall utilise a refusals register to fully record any refused sales or challenges made to patrons. Said register shall be made available for inspection by the police or any other authorised person.

   

  There will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.

   

  All persons under 18 must be accompanied by an adult/parent/guardian/someone over the age of 18.

   

  Children under the age of 18 to be off the premises by 7.00p.m.
