  On New Year’s Eve alcohol may be sold from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 hours (midnight) on 31st December)

   

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal

   

  WITH Children’s Certificate

  No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:

  1        He is the child of the holder of the premises licence.

  2        He resides in the premises, but is not employed there.

  3        He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.

  4        The bar is in premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.

  a)              He is in an area shown on the plan attached to the licence

  b)              Meals and non-alcoholic beverages are available for sale for consumption in that area

  c)              He is in the company of a person aged 18 or over

  d)              He is there:

  (i)    prior to 21.00 hours; or

  (ii)  between 21.00 hours and 21.30 hours where he or the said person is consuming a meal purchased before 21.00 hours

  In this condition “bar” includes any place exclusively or mainly used for the consumption of intoxicating liquor. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals

   

  Mandatory conditions where licence authorises the supply of alcohol

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

   

  Irresponsible Drinks Promotions - Mandatory Conditions

   

  3.              (1)              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children:

   

                              (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to:

   

                                            (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                                            (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

   

                              (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

                              (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

               (d)   selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

                              (e)   dispensing alcohol directly by one person into the mouth of another (other    than where that other person is unable to drink without assistance by reason of disability)

   

  4.              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

        where it is reasonably available.

   

  5.              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available

   

  Age Verification Policy - Mandatory Condition

   

  6.              (1)              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

         (2)  The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

                (3)              The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

   

  (a)              a holographic mark, or

  (b)              an ultraviolet feature

   

  Availability of different Measures - Mandatory Condition

   

  7.              The responsible person shall ensure that:

   

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

   

                              (i)              beer or cider: ½ pint;

                              (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii)              still wine in a glass: 125 ml; and

   

                (b)              these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

        (c)    where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

• Non standard timings

   

  On Christmas Eve, Boxing Day and the Thursday, Friday, Saturday, and Sunday of Bank Holiday weekends regulated entertainment will be permitted until 02.00 hours the following day and the sale/supply of alcohol will be permitted until 01.00 hours the following day and the premises may be open to the public until 02.00 hours the following day

• Conditions Consistent with the Operating Schedule

   

   

  Any outside area, which is used for the consumption of alcohol, shall cease to be so used at 23.30 hours

   

  There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or member and their guests) notices requiring customers to leave the premises and the area quietly

   

  There may be two gaming machines (one in view of the bar) and one cigarette machine in view of the bar otherwise there will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children

   

   

  All members of staff and management will have ongoing training on the provisions of the Licensing Act 2003 and the promotion of the 4 licensing objectives

   

   

  All members of staff concerned with the sale of alcohol to be trained with regard to the sale of alcohol and under 18s.

   

  Daily safety audit to be carried out.

   

  In relation to the sports field licensable activity provisions will only take place between 10.00hrs and 22.00hrs with the exception of New Year’s Eve when the field may be used to host a fireworks display and refreshments no further than 01.00am

   

  Conditions Consistent with the Operating Schedule relating specifically to use of the Sports Field

   

  When the field is being used to provide the provision of regulated entertainment and alcohol, the alcohol will only be dispensed from a temporary structure erected on the field

   

  The entrance to the structure/bar area must be marked appropriately. The entrance to the structure must state that all minors must be accompanied by an adult.

   

  Management must risk asses each event in relation to the provision of SIA registered door staff. The decision making criteria must be recorded in a book kept for that purpose and made available upon request to a police officer or any other authorised officer.

   

  Any temporary structures erected must comply with all fire regulations.  All electrical items must be PAC tested and all equipment used for entertainment must have appropriate safety certificates.  Such safety certificates must be made available upon the request of an authorised officer or police officer.

   

  Adequate parking should be provided for any event wherever reasonably practicable.

   

  During and live or recorded music event, directional speakers must be pointed away from any noise sensitive dwellings.

   

  Litter bins must be provided at all events and disposal of rubbish will be the responsibility of the premise licence holder.

   

  Any area/ temporary structure designed for the provision of alcohol must clearly display the Challenge 25 policy and all staff must be trained in the implementation of that policy

   

  Any large event must have the facility to secure and protect any children reported lost during an event and have the facility to raise the alarm to the parent and where necessary to the appropriate authority.

   

  Any incidents involving children must be recorded in a book kept for that purpose.  Such book to be made available for inspections upon the request of an authorised officer or police officer.

   

  Conditions agreed with the police

   

  There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age.  That policy shall require any person who appears to be under the age of 25 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age. Armed Forces ID is also acceptable.

   

  To utilise and fully record any refused sales or challenges made to patrons and such records be kept in an appropriate form and be made available on inspection to the police or other authorised agency.

   

  All staff will successfully complete training in age related products prior to operating a till on the sales floor. Refresher training will also be successfully completed not more than every 6 months, this will be fully documented and be available for inspection to police officers or other authorised persons

   

  Where CCTV equipment is installed it shall be maintained in good working order in accordance with the manufacturer's instructions. Training should be provided for staff members in the usage of the CCTV equipment. CCTV footage recorded must, as a minimum, cover each entry/exit point of the premises and points of sale. It must be recording at all times when the premises are conducting licensable activities (except in the case of mechanical faults which should be rectified as a matter of urgency)

   

  The recorded images shall be retained in unedited form for a period not less than 28 days. The Data Controller will make footage available within a reasonable time to a Police Constable or Authorised Officer, where such request is made in accordance with and which satisfies the Data Protection Act 1998.

   

  In relation to any events on the field area:

   

  Events utilising the field area are limited to Caton Gala once a year.

   

  For any other planned events, Police must be consulted to risk assess each event at least one month in advance and any recommendations implemented.

   

  Adequate SIA Security supported by Marshalls shall be on duty covering all entrances/exits

   

  Alcohol suppy and consumption  only to be from the temporary structure erected on the day which should be in a clearly defined area & no unaccompanied children allowed in this area.

   

  DPS or assistant manager to be on duty for duration of any event

   

   

               

   

               

   

   

   

   

   

   

• Conditions attached after a hearing by the Licensing Authority

   

  The sale and supply of alcohol and provision of regulated entertainment should finish at 23.30 hours Sunday to Thursday, with the premises closing at midnight.  For Friday and Saturday nights, and the non standard occasions set out in the operating schedule, the variation is granted in accordance with the application.
