  On New Year’s Eve alcohol may be sold from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 hours (midnight) on 31st December)

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal

   

  NO Children’s Certificate

  No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:

  a)              He is the child of the holder of the premises licence.

  b)              He resides in the premises, but is not employed there.

  c)              He is in the bar solely for the purpose of passing to or from some part of the premises that is not a bar and to or from some part of the premises where there is no other convenient means of access or egress.

  d)              The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which holding of the licence is ancillary.

  In this condition “bar” includes any place exclusively or mainly used for the consumption of intoxicating liquor.  However, an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

   

  Mandatory conditions where licence authorises the supply of alcohol

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory condition where the licence permits the performance of Films

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

  Re residents

  Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.

   

  The premises must be bona fide used for the purpose of habitually providing for reward board and lodging including breakfast and one other at least of the customary main meals.

   

  Intoxicating liquor shall be sold/supplied only to:

  a)              Residents in the hotel and their bona fide guests

  b)              For consumption off the premises when supplied with a substantial meal supplied in lieu of the customary main meal at midday or in the evening or both. There are no other off sales

   

  There shall be afforded in the premises for persons provided with board and lodging for reward adequate sitting accommodation in a room not used or to be used for

  )          sleeping accommodation; or

  )          the service of substantial refreshment; or

  the supply or consumption of alcohol

• Non standard timings

  On New Year’s Eve regulated entertainment and the sale/supply of alcohol will be permitted from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day and the premises may be open to the public from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day

• Offered Conditions

   

  1        A personal licence holder shall normally be on the premises at all times during which intoxicating liquor is being sold or supplied to customers or consumed by customers, except in the case of an emergency

  2        Whenever the designated premises supervisor is not at the premises another personal licence holder will be nominated by the designated premises supervisor as being the responsible person to manage the premises and will have the contact details of the designated premises supervisor. The details of such person to be on prominent display outside the premises

  3        Any person who looks or appears to be under the age of 18 shall be asked to provide identification that they are over the age of 18.  The following are the only forms of identification acceptable: UK photo driving licence; Passport; PASS card (proof of age standards scheme)

  4        Any outside area, which is used for the consumption of alcohol, shall cease to be so used at 23.00 hours

  5        The provision of off-sales to terminate at 23.00 hours

  6        The maximum number of persons (including staff) allowed to be on premises at any time shall be200 (Function Room and bar) and 200 (Lounge / dining room)

  There will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children

   

  Operating Schedule

   

  a)  General - all four licensing objectives (b,c,d,e) (please read guidance note 9)

   

  The maximum occupancy figure for inside the Function suite will remain at 200 and inside the Lounge/Dining Room will remain at 200, the occupancy figure already having been agreed with the Licensing Authority and with the Fire and Rescue services based on fire safety issues, available floor space and sanitary accommodation available.

   

  The applicants have considered the terms of the local licensing policy in preparing this application.

   

  No new steps have been identified by risk assessment in relation to the four licensing objectives, except as indicated in these (b), (c), (d) and (e).

   

  It is considered that any additional steps will be required in view of the nature of the premises and their situation, particularly having regard to the fact that the operation of the premises under the Licensing Act 2003 is not intended to be significantly different to the operation conducted under the provisions of the Licensing Act 1964.

   

  b) The prevention of crime and disorder

   

  1                    Staff are aware of the need for vigilance and the premises have enjoyed a good reputation as being well run and free from crime and disorder issues.

  2                    There have been no issues as to the use of illegal drugs on the premises although the applicants are well aware of the potential problems and remain aware at all times.

  3                    In view of the customer base and trading history of these premises, no requirement for door staff has been identified by our risk assessment.

  4                    Customers in the dining area are normally seated at all times.

  5                    Staff are trained and aware of their duties under the Licensing Act 2003 and in particular the importance of complying with the Act and ensuring that customers comply with the requirements of the criminal law.

  6                     

  c) Public safety

   

  7                    The applicants have considered the terms of the local licensing policy in preparing the application.

  8                    There are no specific issues other than those which are covered by existing provisions and statutory regulations.

  9                    Fire precautions in place comply with all the requirements of the Fire Officer.

  10                The clientele in the hotel are normally predominantly resident which limits the numbers present at any one time.

  11                Existing PEL conditions.

   

  d) The prevention of public nuisance

   

  12                The majority of guests stay in the hotel. People attending the predominantly private functions will normally leave reasonably quickly and quietly at the end of those functions rather than moving on towards other licensed premises in the vicinity.

  13                No new steps have been identified by risk assessment in relation to the four licensing objectives.

  14                The applicants will provide a 30 minute winding down period at the end of the permitted hours in order to ensure non-residents leave in a quiet and orderly manner.

  15                Premises cater for the more mature customer and there has been no previous history of problems arising when customers leave the premises.

  16                The solid construction and location of the hotel ensures that there is unlikely to be a disturbance to passers by or residents in the area.

  17                Existing PEL conditions.

   

  e) The protection of children from harm

   

  18                No additional requirements other than the statutory obligations imposed under Licensing Act 2003.

  19                Staff are trained to remain vigilant in ensuring that underage persons do not have access to alcohol.

  20                The applicants have considered the terms of the local licensing policy in preparing this application.

  21                No new steps have been identified by the risk assessment in relation the 4 licensing objectives, except as indicated.

  22                The nature and style of the premises and the service provided do not appeal to younger people.
