PLACES OF PUBLIC ENTERTAINMENT
CONDITIONS OF LICENCE
1. DIVISION INTO PARTS
These Conditions are divided into parts as follows
Part 1 General
Part 2 Conditions that apply to all premises
Part 3 Additional conditions for premises used for cinema exhibitions.
Part 4 Additional conditions for premises used for stage presentations.
2. DEFINITIONS
In these Conditions unless the context otherwise requires -
“Licensing Authority” means Lancaster City Council.
“Normal or General Lighting” means all lighting other than emergency or safety lighting permanently installed in those parts of the premises to which the public have access. The term may include purely decorative lighting but not lighting installed solely for advertising purposes.
“Emergency or Safety Lighting” means lighting obtained from a source independent of the normal or general supply for the building provided to assist the public, performers and staff to leave the premises without the aid of the normal general lighting.
“Platform” means that part of the public assembly space which is arranged for the accommodation of performers and which is not a stage.
“Stage” means that part of a building associated with a hall or auditorium which is constructed or arranged for the performance of plays or similar entertainment’s.
“Stage Area” means the stage, together with any stage basement and any scene dock, workshop, staff room, store or other parts ancillary to it.
“Premises” means a place, an enclosure; a building or that part of a building used f or public assembly and all other buildings within a place containing services or installations used in connection with the assembly.
“Suitable Plan” means a legible scale drawing of the premises preferably at a scale of 1:100 (metric).
“Place of Safety,” means a place in which persons are in no danger from fire.
“Fire Resistance” means the ability of an element of building construction to satisfy for a stated period of time the criteria specified in British Standard 476: Part 8, namely, resistance to collapse, resistance to flame penetration and resistance to excessive temperature rise on the unexposed face.
“Surface Spread of Flame” means material used for wall and ceiling linings, acoustic or thermal insulation linings should normally be non-combustible or be rated Class 1 for surface spread of flame when tested in accordance with the appropriate provisions of British standard 476:Part 7:1971. Class 1 and Class 0 shall be as prescribed by the current Building Regulations / British Standards.
“Licensee” shall, in the case of a Cinematograph Licence, include, where the context so admits, the owner of the cinematograph or other apparatus, the occupier of the licensed premises, the responsible person nominated in writing by the licensee to be in charge of the premises in pursuance of the Regulations of the Secretary of State and any other person who is for the time being in charge of the premises.
3. DISPENSATION OR MODIFICATION OF CONDITIONS
These Conditions may be dispensed with or modified by the Licensing Authority in any special case.
PART 2 - CONDITIONS WHICH APPLY TO ALL PREMISES
1 LICENCE TO BE KEPT ON PREMISES
This Licence must be kept on the licensed premises and must be accessible to the licensee and produced on demand to any duly authorised person.
2 HOURS OF OPENING AND CLOSING
The licensed premises shall not be opened for the purpose for which this licence is granted otherwise than in accordance with the permitted opening times specified in the licence.
3 PLANS
At the time of application for grant or transfer of Entertainment Licence, a suitable plan of the premises shall be provided, together with such other information deemed necessary for the Licensing Authority.
4 CHARGE OF LICENSED PREMISES AND ATTENDANTS
) The licensee or a responsible person nominated by him in writing for the purpose shall be present and in charge of the premises during the whole of the time that they are open to the public. During that time, there shall be on duty in the premises such number of attendants as may be required by the Licensing Authority and as laid down in the Schedule attached to these conditions.
) The attendant or attendants with primary responsibility for ensuring that the public leave the premises safely in the event of an emergency shall be not less than eighteen years of age.
1 MAINTENANCE OF ORDER
The Licensee shall be under a duty to maintain good order, conduct and decency on the
2 HYPNOTISM
Consents
) Any exhibition, demonstration or performance (hereafter referred to as a “performance”) of hypnotism (as defined in the Hypnotism Act 1952) on any person requires the express written consent of the licensing authority and must comply with any attached conditions. The authority may consent, either, under the terms of a public entertainment licence or under the provisions of the Hypnotism Act 1952.
Applications
) An application for consent under condition (a) shall be in writing and signed by the applicant or his agent and shall normally be made not less than 28 days in advance of the performance concerned. This period may be reduced in the case of a hypnotist who has performed at the same venue within the last three years without any problems occurring. The authority will normally respond within 7-14 days; less where the hypnotist has previously performed at the same venue.
) The application shall contain the following:the name (both real and stage, if different) and address of the person who will give the performance (hereafter referred to as the “hypnotist”), along with details of their last three performances (where and when); and
) a statement as to whether, and if so giving full details thereof, the hypnotist has been previously refused, or had withdrawn, a consent by any Licensing Authority or been convicted of an offence under the Hypnotism Act 1952 or of an offence involving the breach of a condition regulating or prohibiting the giving of a performance of hypnotism on any person at a place licensed for public entertainment. (Refusal of consent by another authority does not necessarily indicate that the particular hypnotist in unacceptable and will not of itself prejudice the application.)
Conditions
) The following conditions shall apply to any consent given:
Publicity
) no poster, advertisement or programme for the performance which is likely to cause public offence shall be displayed, sold or supplied, by or on behalf of the licensee either at the premises or elsewhere;
) every poster, advertisement or programme for the performance which is displayed, sold or supplied shall include, clearly and legibly, the following statement:
“Volunteers, who must be aged 18 or over, can refuse at any point to continue taking part in the performance.”
Insurance
) the performance shall be covered to a reasonable level by public liability insurance. The hypnotist must provide evidence of this to the local authority if requested; and it must be available for inspection at the performance;
Physical Arrangements
) the means of access between the auditorium and the stage for participants shall be properly lit and free from obstruction;
) a continuous white or yellow line shall be provided on the floor of any raised stage at a safe distance from the edge. This line shall run parallel with the edge of the stage for its whole width. The hypnotist shall inform all subjects that they must not cross the line while under hypnosis, unless specifically told to do so as a part of the performance.
Treatment of Audience and Subjects
) before starting the performance the hypnotist shall make a statement to the audience, in a serious manner, identifying those groups of people who should not volunteer to participate in it; explaining what volunteers might be asked to perform; informing the audience of the possible risks from embarrassment or anxiety; and emphasising that subjects may cease to participate at any time they wish. The following is a suggested statement, which might be amended as necessary to suit individual styles so long as the overall message remains the same:
“I shall be looking for volunteers, aged over 18, who are willing to be hypnotised and participate in the show. Anyone who comes forward should be prepared to take part in a range of entertaining hypnotic suggestions but can be assured that they will not be asked to do anything which is indecent, offensive or harmful. Volunteers need to be in normal physical and mental health and I must ask that no one volunteers if they have a history of mental illness, are under the influence of alcohol or other drugs or are pregnant.”
) No form of coercion shall be used to persuade members of the audience to participate in the performance. In particular, hypnotists shall not use selection techniques that seek to identify and coerce onto the stage the most suggestible members of the audience without their prior knowledge of what is intended. Any use of selection techniques (e.g. asking members of the audience to clasp their hands together and asking those who cannot free them again to come onto the stage) should only be used when the audience is fully aware of what is intended, and that participation is entirely voluntary at every stage;
) If volunteers are to remain hypnotised during an interval in the performance, a reasonable number of attendants as agreed with the licensing authority shall be in attendance throughout to ensure their safety;
Prohibited Actions
) The performance shall be so conducted as not to be likely to cause offence to any person in the audience or any hypnotised subject.
) The performance shall be so conducted as not to be likely to cause harm, anxiety or distress to any person in the audience or any hypnotised subject. In particular, the performance shall not include:
Any suggestion involving the age regression of a subject (i.e. asking the subject to revert to an earlier age in their life; this does not prohibit the hypnotist from asking subjects to act as if they were a child etc.);
Any suggestion that the subject has lost something (e.g. a body part) which, if it really occurred, could cause considerable distress;
Any demonstration in which the subject is suspended between supports (so-called “catalepsy);
The consumption of any harmful or noxious substance;
Any demonstration of the power of hypnosis to block pain (e.g. pushing a needle through the skin).
The performance shall not include giving hypnotherapy or any other form of treatment;
Completion
) All hypnotised subjects shall remain in the presence of the hypnotist and in the room where the performance takes place until all hypnotic suggestions have been removed;
) All hypnotic or post-hypnotic suggestions shall be completely removed from the minds of the subjects and the audience before the performance ends. All hypnotised subjects shall have the suggestions removed both individually and collectively, the hypnotist shall confirm with each of them that they feel well and relaxed (the restriction on post-hypnotic suggestions does not prevent the hypnotist telling subjects that they will feel well and relaxed after the suggestions are removed);
) The hypnotist shall remain available for at least 30 minutes after the show to help deal with any problems which might arise. (Such help might take the form of reassurance in the event of headaches or giddiness but this condition does not imply that the hypnotist is an appropriate person to treat anyone who is otherwise unwell.)
Authorised Access
) Where:
a constable; or
an authorised officer of the licensing authority; or
an authorised officer of the fire authority
has reason to believe that a performance is being, or is about to be, given he may enter the venue with a view to seeing whether the conditions on which approval for the performance was granted are being complied with.
7. PROHIBITION OF OBSCENE PERFORMANCES OR ENTERTAINMENT
) No obscene performance or entertainment shall be provided at the premises, and
) for the purposes of this condition, a performance or entertainment shall be deemed to be obscene if, taken as a whole, its effect is such as to tend to deprave and corrupt persons likely to attend it.
8. CONDITIONS FOR STRIPTEASE AND NUDITY PERFORMANCES
) No performance involving striptease or nudity will take place without the prior approval of the Council.
) applications for approval will be in writing and will detail (together with an adequate plan of the premises):
) The performance area.
The means of access and egress to and from the performance area.
The dressing room arrangements.
Stewarding arrangements, including the means by which physical contact between the audience and performers will be prevented.
The appearance and content of advertising material outside and inside the premises.
The means by which potential customers will be made aware of the nature of the performance.
No persons under 18 years of age will be admitted to premises where an approved performance is taking place.
d) Premises used for an approved performance will be equipped with a closed circuit television system installed and maintained to the satisfaction of the Chief Constable and the Council’s Licensing Inspector. All cameras shall continually record during striptease and nudity performances and the video recordings shall be kept available for a minimum of 28 days with accurate time and date markings. Tape recordings shall be made immediately available to an authorised officer of the Council or a Police Officer.
e) Premises used for an approved performance will be equipped with a means of controlling the number of persons admitted to the premises and/or assembling in the performance area to the satisfaction of the Chief Officer of the Lancashire Fire and Rescue Service in conjunction with the Council’s Licensing Inspector.
f) No performance shall involve physical contact between the performer(s) and any other person.
g) No performance shall involve the use of sex articles (as defined in the Local Government (Miscellaneous Provisions) Act 1982) and performers shall at all times wear a g-string or similar clothing on the appropriate part of the body.
) Performances shall not be the subject of any advertising involving the distribution of leaflets, promotion by canvassers or by touting.
) Neither the licensee, performer(s) or any person concerned with the licensed premises or the entertainment shall encourage or permit others to encourage the audience to throw money or to otherwise give gratuities to the performers.
NOTE: This provision shall not apply to premises approved for pole dancing or table dancing.
9. GAMING
No gaming shall be permitted on the premises except in accordance with a Licence granted under the Gaming Act, 1968.
10. OVERCROWDING
The number of persons allowed in any area licensed for entertainment shall be limited to keep within the occupancy figure laid down by the Licensing Authority.
Overcrowding in such a manner as to cause danger to any person shall not be permitted in any part of the premises.
11. MAINTENANCE OF PREMISES
All parts of the premises, services and fittings therein, including the seating, door fastenings and notices, shall be maintained at all times in good order and condition.
12. MEANS OF ESCAPE IN CASE OF FIRE
) The premises shall be provided with such means of escape in case of fire for all persons resorting thereto as may reasonably be required in the circumstances of the case.
) All such means (including external escape routes to a place of safety) approved by the Licensing Authority shall be properly maintained in an efficient state, in efficient working order, in good repair and shall be kept free from obstruction at all times when the premises are occupied.
) Fire resisting doors fitted with self-closing devices, other than approved automatic releases, shall be maintained positively self-closing at all times and shall not be provided with any means of keeping them in the open position.
) Fire resisting doors fitted with self-closing devices and approved automatic releases shall not be provided with any other means of keeping them in the open position.
) All doors, through which a person may have to pass, shall be maintained freely available for exit purposes. They shall be fitted only with approved fastenings which are easily and immediately operable, without recourse to the use of a key, by any person leaving the premises in the event of an emergency. Fastenings other than automatic panic bolts shall be made inoperative whilst the public are present on the premises. The method of operating any such fastenings, e.g. PUSH BAR TO OPEN, shall be conspicuously displayed on or adjacent to the fastening to the satisfaction of the Licensing Authority. The words shall be displayed in 100 mm white block lettering on a green background or in such other form as the Licensing Authority may approve. All exit doors shall open outwards and be clear of any steps. Any doors, which do not open outwards, shall be locked back in the open position throughout the time that the public is present.
) All escape routes, including stairways and steps, comprising the means of escape in case of emergency shall be maintained with non-slip and even surfaces.
) All stair and floor coverings, mats, etc. shall be secured and maintained so that they will not in any way be a source of danger to persons escape in case of emergency.
) All floors walls and ceilings shall be kept in a satisfactory state of repair. All wall and ceiling linings shall be to the satisfaction of the Licensing Authority. In general, all wall and ceiling linings on exit routes shall be treated to achieve Class ‘0’ resistance to surface spread of flame and to general areas Class ‘1’.
) Any door off the auditorium or exitways, which does not lead to an exit, shall be subject to such conditions as the Licensing Authority may direct.
) Any barrier or temporary barrier shall not be erected or installed without the prior approval of the Licensing Authority.
) When so required by the Licensing Authority, diagrammatic plans showing escape routes shall be publicly displayed, where necessary, these shall be supplemented by prominently displayed directional signs showing the routes to be taken to emergency exits.
) Fastings
1) No fastenings, other than automatic bolts, shall be fitted on exit doors used by the public. Automatic bolts shall be of such a pattern that horizontal pressure on the crossbars will open the doors.
2) If the Licensing Authority gives consent to the use of chains, padlocks or other devices for securing exit doors when the public are not on the premises, a responsible person shall be required to remove such chains, padlocks, or other devices before the admission of the public. Chains, padlocks or other devices shall not be replaced during the whole time the public is present in the licensed premises.
3) Such padlocks and chains shall be placed on a specially prepared notice board in a prominent position that can be easily seen by the licensee. There should be a hook to receive each padlock and chain being numbered with corresponding number of the appropriate door(s). The specially prepared notice board shall have the following “NOTICE” to read in 16mm high block letters:
THE PADLOCKS AND CHAINS FITTED TO EXIT AND ENTRANCE DOORS FOR SECURITY PURPOSES ARE TO BE REMOVED FROM THE DOORS AND PLACED ON THIS BOARD PRIOR TO THE PUBLIC BEING ADMITTED. THESE PADLOCKS AND CHAINS MUST NOT BE REPLACED ON THE DOORS UNTIL THE ENTIRE PUBLIC HAVE LEFT THE PREMISES.
4) Doors to external courts and passageways which open inwards and all collapsible gates, rollers and sliding shutters shall, while the public are on the premises, be locked in the fully open position in such a way that a key is required to release them. By such doors, gates and shutters, a notice shall be erected as follows:
“THIS GATE MUST BE KEPT OPEN AND LOCKED IN THAT POSITION WHENEVER MEMBERS OF THE PUBLIC ARE ON THE PREMISES”
5) The lettering shall be to the satisfaction of the Licensing Authority.
6) All removable bolts, chains or padlocks and keys used for securing the entrance doors of the premises or the doors to any external courts or passageways shall be removed before the admission of the public to the premises and shall not be replaced until the public have left the premises. Such bolts, chains, padlocks and keys shall be kept where they are available only to the person in charge of the premises.
) The contents of any room in the premises shall be so arranged or disposed as to provide for any persons therein an unobstructed escape route to a means of escape in case of emergency. Only such parts of the premises as have been approved by the Licensing Authority shall be used as retiring rooms or cloakrooms and provisions for hanging hats or coats shall not be made in corridors, passages, gangways or exit ways used by the public.
) Where necessary, the nosing of steps in the premises to which the public have access shall be maintained conspicuous to the satisfaction of the Licensing Authority.
) Hangings or curtains over exit doors or across gangways shall be made to part in the centre to hang so as to be readily drawn aside and not trail on the floor and be arranged so as not to conceal notices.
) Minimum headroom height to all exit doorways, public areas and staircases shall be as prescribed by the Building Regulation Authority and Licensing Authority.
) Where practicable, a continuous and uninterrupted handrail shall be fixed on both sides of all staircases and landings used by the public. Where the staircase is 1.8 metres in width and upwards, a central handrail shall be provided properly supported and secured to the steps. Similar handrails shall be provided on any ramp, the slope of which exceeds one in ten, and in no case shall the slope of any ramp exceed a gradient of 1 in 12.
13. EXIT SIGNS
) All exit doors or openings approved by the Licensing Authority shall be clearly marked by the ‘EXIT’ or other approved wording to the satisfaction of the Licensing Authority.
) Door and openings, other than exits which lead to portions of the premises accessible to the public shall have notices placed over them indicating the use of such portions to be marked ‘PRIVATE’.
) Such additional notices and signs indicating the way out of the premises shall be provided, as the Licensing Authority may consider necessary.
) Notices bearing the words ‘NO EXIT’ shall not be provided.
) The notices referred to in this condition shall be, where practicable, at a height of at least 2 metres to 2.5 metres above the floor and, where possible shall be placed over the doors or openings to which they relate.
) All new and replacement signs shall comply with the current British Standard.
14. SEATING AND GANGWAYS
) The seating and gangway arrangements within the premises shall be to the satisfaction of the Licensing Authority in accordance with approved seating plans.
) Facilities for disabled persons shall be to the satisfaction of the Licensing Authority.
15. CEILINGS
) The licensee shall report to the Licensing Authority whenever it is proposed to redecorate or erect scaffolding in the public part of the premises and shall then arrange for the ceiling of such part of the premises to be examined on his behalf by a competent technical adviser. The licensee shall notify the Licensing Authority of the examination and shall permit a technical officer on behalf of the Licensing Authority to be present to ensure that such examination is as thorough as circumstances will allow.
) If redecoration does not take place within five years, from the date of the last inspection, of the ceiling of the premises, or, if the Licensing Authority shall at any time so require, a special inspection and examination of such ceiling shall be carried out, on behalf of the licensee, by a competent technical adviser. The licensee shall notify the Licensing Authority of the examination and shall permit a technical officer on behalf of the Licensing Authority to be present for the purpose aforesaid.
) The fact that an inspection has been carried out in the presence of a technical officer representing the Licensing Authority will not relieve the licensee of his primary responsibility for the safety of the premises.
) Whenever any such inspection and examination is carried out, a certificate in the form prescribed by the Licensing Authority shall be furnished by the licensee to the Licensing Authority.
) When redecoration is undertaken, all ceiling surfaces and linings shall be specially treated to achieve a minimum of Class ‘1’ resistance to surface spread of flame unless otherwise specified.
) When practicable, adequate access shall be provided and maintained to the satisfaction of the Licensing Authority to the roof voids above the public parts of the premises for the purpose of inspection.
16. TOILETS
) Adequate and separate toilet and washing facilities shall be provided for persons of each sex to the satisfaction of the Licensing Authority.
) All water closets and urinals shall at all times be kept in good working order and repair and be properly and effectively cleaned, ventilated, disinfected and supplied with water.
) The position of toilets for each sex shall be clearly indicated.
17. ACCESS TO COLD DRINKING WATER
There shall be provided at the premises free and unrestricted access to cold drinking water at all times without charge.
18. CLOAKROOMS
Cloakrooms for males and females shall be provided to premises licensed for entertainment.
19. HOUSEKEEPING
All parts of the licensed premises shall at all times be kept thoroughly cleaned to the satisfaction of the Licensing Authority. Unnecessary combustibles shall not be allowed to accumulate on the premises.
20. ELECTRICAL INSTALLATION
) All electrical fittings, wiring and appliances shall be constructed, installed and maintained to the satisfaction of the Licensing Authority having regard to Statutory Regulations, as applicable, and to their approved standard which, in general, is a screwed steel conduit installation or its equivalent. Any adaptation, modification or extension, whether permanent or temporary, shall conform to the then current Regulations for the Electrical Equipment of Buildings issued by the Institution of Electrical Engineers.
) An appropriate Residual Current Device (RCCD.) must protect all portable electrical equipment.
) A certificate of safety, signed by a registered Electrical Contractor or competent electrical engineer, certifying that the complete installation is maintained in a safe and satisfactory condition, shall be submitted to the Licensing Authority, if so required, prior to the grant or renewal of a licence. To accord with Cinematograph (Safety) Regulations, 1955, certificates are required to be submitted once a year.
21. NORMAL OR GENERAL LIGHTING
All parts of the premises, including external escape routes to a place of safety, shall be provided with adequate and permanent normal lighting system, the control and installation of which shall be to the satisfaction of the Licensing Authority.
22. EMERGENCY LIGHTING FOR SAFETY LIGHTING UNDER THE CINEMATOGRAPH SAFETY REGULATIONS 1955.
An emergency lighting or safety lighting system (in addition to the normal lighting) shall be installed in the premises to the satisfaction of the Licensing Authority. Such lighting shall be switched on (where appropriate) and be in good working order at all times when the public is present on the premises.
23. TEMPORARY ELECTRICAL INSTALLATION
) In premises having a stage or platform provided with a permanent installation for the lighting of the productions, arrangements shall be made for the full utilisation of such permanent installation, so far as practicable, before the use of additional temporary installed equipment.
) Where the use of temporary installations is unavoidable for a stage play production, discotheque or any other specific function, such wiring or equipment shall be under the control of a competent person who shall ensure the following:
) Safe erection and installation within the appropriate requirements relating to temporary installations specified in the current edition of the Regulations for the Electrical Equipment of Buildings issued by the Institution of Electrical Engineers.
) Safe use.
) Disconnection and removal after use.
) Display of the name and competent person and designation at the point of connection or control.
Special conditions apply to the safe use of lasers and other special effects and these are outlined on Lancaster City Council Licensing Form E 10 that is available on request.
24 FAILURE OF LIGHTING
If there is a failure of electric lighting (normal or emergency) the public shall be instructed to leave the premises by the end of one hour of continued failure (three-hour category emergency lighting) or forty minutes (two-hour category emergency lighting
25. SHOWCASES
Electrical wiring or apparatus shall not be installed in showcases containing readily combustible materials.
26. STAGE LIGHTING
All stage lighting equipment shall be so installed and erected so as to prevent contact with scenery or other combustible materials.
27. LAMP HOLDERS
All lamp holders shall be kept fitted with lamps.
28 GAS INSTALLATION
Any gas installation shall comply with the then current Gas (Safety) Regulations.
29 HEATING INSTALLATION
) Heating installations shall comply with current statutory regulations and codes of practice.
) All heaters shall be permanently fixed in position and shall be fitted with appropriate protected guards.
) Heaters of a portable type shall not be used.
) Portable gas bottles or cylinders for any purpose shall not be permitted within the premises. Bulk supply installations shall be installed in strict compliance with current codes of practice.
) All open fireplaces or stoves shall be properly protected by the installation of suitable spark guards.
30 VENTILATION
Adequate ventilation to all parts of the premises shall be provided to the satisfaction of the Licensing Authority.
31 FIRE ALARM SYSTEM
Where deemed necessary, an adequate fire alarm system shall be provided to the satisfaction of the Licensing Authority in accordance with the current British Standard. The system shall be in good working order at all times when the public are present on the premises.
32. REPORTS OF OUTBREAKS OF FIRE
) All outbreaks of fire or suspected outbreaks shall be immediately reported to the Fire Brigade.
) At all times when the public are present, it shall be the specific duty of at least one responsible person to call the Fire Brigade in case of fire or any suspected fire. Such person(s) should know the location of the nearest telephone and the nearest alternative telephone and be familiar with the emergency method of calling the Brigade.
) A notice shall be kept on the premises giving instructions concerning the quickest available method of calling the Brigade.
33. FIRE EQUIPMENT
Fire fighting equipment shall be provided and maintained to the satisfaction of the Licensing Authority. All fire extinguishers shall be mounted in a manner approved by the Licensing Authority. Arrangements shall be made whereby the fire equipment receives regular annual inspection of practice. The date of such tests should be clearly marked on the equipment or on stout tabs attached thereto.
34. WATER SUPPLY
The licensee shall notify the Licensing Authority immediately if the water supply to the hydrant, hose reel, sprinkler, drencher and other fire extinguishing installation is cut off or restricted.
35. ACCESS FOR FIRE BRIGADE
Adequate access for Fire Brigade vehicles and equipment should be provided at all times.
36. TRAINING AND INSTRUCTIONS IN CASE OF FIRE
All persons employed to work in the premises shall be given instruction and training in the procedure to adopt in case of fire and specific details of this shall be recorded in the logbook. The instruction and training shall include the following:
) Written information shall be made readily available to all staff.
) All members of staff shall receive instruction and training appropriate to their particular responsibility in the event of an emergency.
) Exercises for the staff only shall be held regularly to ensure the efficient operation of the procedure for dealing with an emergency.
37. LOG BOOK
Where required by the Licensing Authority, a suitable logbook, which shall be produced on request to any of the persons, mentioned in condition 46 should be provided and signed by the licensee weekly, in which shall be recorded-
) Record of fire drills.
) Any failure of or in the normal, emergency or safety lighting system and the action taken.
) Any outbreak of fire.
38. FURNISHINGS AND UPHOLSTERY COVERINGS
All new or replacement materials used for upholstery shall be suitably treated for flameproofing to British Standard 5852: Part 1:1979 and Part 2:1982 and evidence of such treatment shall be provided as appropriate.
39. SCENERY DECORATIONS
All scenery or decorations shall be of either inherently flame retardant material or be rendered so and maintained in that condition. Highly flammable and readily ignitable materials, such as paper, celluloid and cotton wool shall not be used.
40. REAL FLAME DANGEROUS MATERIALS AND EFFECTS
) Naked flames and lights, flash powder, explosives or highly flammable materials shall not be used in any performance except with the permission of the Licensing Authority.
) Such materials to be used only when essential to the action as distinct from the atmosphere of the performance.
) Special conditions apply to the use of certain special effects and these are outlined on Form E 10 that is available on request.
41. FLAMMABLE MATERIALS AND LITTER
) All dirt, rubbish or flammable waste material shall be kept in suitable containers which shall be kept outside the premises or in a place within the premises approved by the Licensing Authority. Storage of equipment shall be permitted in parts of the premises authorised by the Licensing Authority.
) Metal containers with fitted lids shall be provided in all dressing rooms for the reception of litter and waste.
42. SMOKING
Smoking shall be strictly prohibited in any stage and dressing room areas and notices to this effect shall be prominently displayed in suitable places.
43. PUBLIC NUISANCE
The licensee shall not use the premises so as to cause annoyance or be a nuisance.
44. STRUCTURAL AND ELECTRICAL ALTERATIONS
Alterations or additions, whether permanent or temporary, to the structure, the lighting, heating or ventilating installations or to the seating, gangways or other arrangements at the premises shall not be made except with the prior approval of the Licensing Authority. Copies of the plans of the proposed alterations or additions shall be deposited with the Licensing Authority, Fire Authority and Chief Officer of Police. In new or altered works to licensed premises where Building Regulations apply, premises should be completed to the full Building Regulation Standards as approved by the Building Control Department of the Licensing Authority.
45. SUPERVISION OF CHILDREN
In premises where children and parents are likely to be separated or use different floors, the Licensing Authority shall be informed.
46. DISABLED PERSONS
Arrangements for the admission of disabled persons to the premises shall be made and maintained to the satisfaction of the Licensing Authority.
47. ENTRY AND INSPECTION
Any authorised Officer of the Licensing Authority or the Fire Authority may, at any reasonable time, enter and inspect the premises in respect of which a licence is in force for the purpose of ensuring that the terms, restrictions and conditions on or subject to which the licence is held are being complied with.
48. EVACUATION OF PREMISES AT TIMES OF EXTREME WEATHER CONDITIONS
Where, in the opinion of a Police Officer of the rank of Superintendent or higher, the weather conditions are such as to create a risk of damage to the licensed premises, or potential loss of life to persons resorting to the licensed premises, the licensee, on being requested to do so by that Police Officer, shall immediately evacuate the licensed premises and keep them closed until permission is given by that Police Officer for the licensed premises to be reopened.
49. REGISTRATION OF SECURITY PERSONS (DOOR STAFF)
No person may be employed or engaged in or about the premises in any capacity concerned with the maintenance of order or the vetting of customers unless he/she is registered with the Council under the Door Staff Registration Scheme. Accurate duty records of the dates and times when every security person is employed at the premises shall be maintained, such records shall be made available for inspection by any Police officer or authorised officer of the Licensing Authority.
PART 3 - ADDITIONAL CONDITIONS for PREMISES USED for CINEMA EXHIBITIONS.
1 GENERAL
These conditions shall be read in conjunction with Part 1 conditions.
2 STATUTORY CONDITIONS
Attention is drawn to the need to comply with the current regulations made by the Secretary of State under the Cinemas Act 1985.
3 FILM CLASSIFICATION
No film shall be exhibited unless: -
) It has received a “U”, “PG”, “15” or “18” certificate of The British board of Censors; or
) It is a current newsreel, which has not been submitted to The British Board of Film Classification.
1 “18” FILMS
No person apparently under the age of 18 years shall be permitted to any exhibition at which there is to be shown any film which has received an “18” certificate from The British Board of Film Classification.
2 “15” FILMS
No person apparently under the age of 15 years shall be permitted to any exhibition at which there is to be shown any film which has received an “18” certificate from The British Board of Film Classification.
3 PERMISSION OF LICENSING AUTHORITY
Not withstanding the conditions hereinbefore contained, a film may be exhibited, or persons or any class of persons may be admitted thereto, if the permission of the Licensing Authority is first obtained and any conditions of such permission are complied with.
4 FILM CLASSIFICATION CERTIFICATE TO BE SHOWN
A representation or written statement of the terms of any certificate given by the British Board of Film Classification shall be shown on the screen immediately before the showing of any film to which it relates and the representation or statement shall be shown for long enough and in a form large enough for it to be read from any seat in the auditorium.
5 NOTICE OF FILM CLASSIFICATION AND TIMES OF SHOWING
There shall be prominently exhibited at each public entrance, whenever the premises are open to the public, a notice indicating in tabular form and in clear bold letters and figures -
) The title of each film to be shown on that day, other than trailers and films of less than five (5) minutes duration;
) The approximate times of commencement of each film;
) Whether each such film has received a “U”, “PG”, “15” or “18” certificate from The British Board of Film Classification; and
) The effect of such “U”, “PG”, “15” or “18” certificate in relation to the admission of persons under the age of 18 years.
1 ADVERTISEMENTS TO INDICATE NATURE OF CERTIFICATE
The nature of any certificate received in respect of a film from The British Board of Film Classification shall be clearly indicated by the figure “U”, “PG”, “15” or “18” certificate in any advertisement of the film displayed at the premises.
2 RESTRICTION IN ADVERTISING
No advertisement displayed at the premises of a film to be exhibited at the premises shall depict as a scene or incident in the film any scene or incident which is not included in the film as certified by The British Board of Film Classification or approved for exhibition by the Licensing Authority, as the case may be.
3 LICENSING AUTHORITY MAY OBJECT TO ADVERTISEMENTS
Where the Licensing Authority has given notice in writing to the licensee of the premises objecting to an advertisement on the grounds that, if displayed, it would offend against good taste or decency or be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that advertisement shall not be displayed at the premises unless the permission in writing of the Licensing Authority is first obtained and any conditions of such permission are complied with.
4 LICENSING AUTHORITY MAY PROHIBIT FILMS
Where the Licensing Authority has given notice in writing to the licensee of the premises prohibiting the exhibition of a film on the grounds that, if exhibited, would offend against good taste or decency or be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that film shall not be exhibited in the premises unless the permission in writing of the Licensing Authority is first obtained and any conditions of such permission are complied with.
5 DEFINITION OF “FILM”
For the purpose of this licence, “film” means any exhibition of moving pictures produced otherwise than by the simultaneous reception and exhibition of television programmes broadcast by the British Broadcasting Authority or the Independent Broadcasting Authority or included in a cable programme service which is, or does not, require to be licensed by the Cable Authority under Section 4 of the Cable and Broadcasting Act 1984.
6 EXHIBITION OF FILM TO THE LICENSING AUTHORITY
If the Licensing Authority request the licensee to exhibit to them any film he shall do so at such reasonable time as the Licensing Authority may in writing direct.
7 ALTERATION OF FILM CATEGORY BY LICENSING AUTHORITY
If the Licensing Authority do not agree with the category in which any film passed by The British Board of Film Classification is placed, they shall be at liberty to alter such category and on notice of such alteration being given by the Licensing Authority to the licensee, the film shall thereafter be treated as being placed in the altered category and the condition applicable to the exhibition of films in such altered category shall be complied with.
8 WASTE FILM
A metal box with a self-closing close-fitting lid suitable for waste film shall be provided in the rewind room and shall be used for no other purpose than for waste film and shall be emptied daily.
9 INFLAMMABLE FILMS
No inflammable cinematograph film shall be carried or conveyed through any part of the building whilst the public are thereon unless the same are carried or conveyed in closed metal boxes.
10 STAFF INSTRUCTION
The persons referred to in Regulation 5(3) of the Cinematograph (Safety) Regulations 1955 shall receive instruction in accordance with the Regulation at least once every twelve months and at least one such person in addition to the person in charge shall be present on duty at all times when the public are on the premises and shall be immediately available in the event of danger or an alarm of fire.
11 ATTENDANTS IDENTIFICATION
All attendants referred to in Regulation 4(3) of the Cinematograph (Safety) Regulations 1955 shall wear either distinctive clothing or suitable armbands or other adequate distinguishing mark.
12 WAITING SPACES
Persons waiting admission to the premises shall not be allowed to congregate in any portion of the premises except in positions approved by the Licensing Authority in writing for this purpose.
13 QUEUES
In case in which persons wait in queues for admission, the licensee shall do what is reasonably necessary to prevent such persons so waiting from obstructing exits, external courts, passageways, stairways and ramps leading to the outside.
14 STANDING
Where the Licensing Authority sanctions standing in pursuance of Regulation 3(4)(a) of the Cinematograph (Safety) Regulations 1955, the area in which such standing is permitted shall be marked with a conspicuous white line, together with/or a conspicuous notice indicating the number of persons permitted to stand in that area.
15 CHILDREN
Where an entertainment organised wholly or mainly for children is provided, no child shall be permitted to be in the front row of seating on any floor of the auditorium above the lowest floor unless accompanied by and in the charge of a person who has attained the age of sixteen years.
PART 4 - ADDITIONAL CONDITIONS for PREMISES USED for STAGE PRESENTATIONS.
1. GENERAL.
These Conditions shall be read in conjunction with Part 2 Conditions.
2. SAFETY CURTAIN.
) In premises where a safety curtain is fitted to the proscenium opening, it shall be clearly marked as such on the auditorium side and shall be lowered at least once during each performance in the presence of the audience.
) In the event of the safety curtain being out of order, the licensee shall immediately notify the Licensing Authority.
) No apparatus, scenery, properties, curtains or hangings shall, at any time during the performance, cross the plane of descent of the safety curtain and shall not in any circumstances interfere with its descent.
) Except with the consent of the Licensing Authority, scenery or properties shall not be placed on the auditorium side of the safety curtain.
3. SHUTTERS to SCENERY STORES, Etc.
In premises where scenery stores / workrooms are provided, shutters to openings for the passage of scenery between the stage and such stores or workrooms shall be kept closed when the public are on the premises.
4. STAGE LANTERNS.
In premises where a stage lantern is provided, the sashes and other moving parts of the lantern light over the stage shall be tested periodically to ensure that they are in efficient working order. There shall be no obstruction to the upward flow of air from the stage to the ventilators and the release lines and other controlling gear shall be kept readily accessible and secured in such a manner as to permit of their immediate release. The notices indicating the release lines shall not be obscured. Some spare fusible links shall be kept in reserve. The result of each test required by this rule and a statement that the arrangements are in accordance with this rule shall be recorded in the logbook.
5 FIREMAN.
If required by the Licensing Authority, a competent person shall be in charge of fire precautions during the whole time the premises are open to the public. He shall have no duties that will prevent him from being immediately available in the event of a fire and he shall be responsible for the following duties: -
) To check the fire equipment before the public enters the premises.
) To be ready to use the equipment quickly and efficiently.
) To see that exits and exit routes are kept free from obstruction.
6 NOTICE to LICENSING AUTHORITY.
Where an annual licence is in being, at least fourteen days’ notice in writing shall be given to the Licensing Authority specifying the date on which a new production will begin to be presented.
7 STORAGE of SCENERY, Etc.
Scenery or properties, other than those required for use in current productions, shall be stored only in positions approved by the Licensing Authority.
8 SUSPENSION of SCENERY.
All ropes or other means employed for the suspension of scenery, etc., together with associated pulleys, winches, etc., shall be regularly checked by a competent person appointed by the licensee at such intervals as may be deemed necessary by the Licensing Authority.
9 ENTRY and INSPECTION.
An authorised officer of the Fire Authority may, on giving not less than 24 hours’ notice to the occupier of any place in respect of which a licence under the Theatres Act, 1968 is for the time being in force, enter the place for the purpose of:
) Inspecting the place to ensure that there are adequate fire precautions; and
) Seeing whether the terms, conditions or restrictions relating to fire precautions on or subject to which the licence is held are being complied with.
FIRST SCHEDULE - LANCASTER YOUTH ARTS CENTRE
The maximum occupation allowed on these premises is 200 persons or as per approved seating layouts.
The licence and conditions should be clearly displayed within the premises.
The use of the hall for stage productions is restricted to 12 days in any 12 month period.
Seating should be laid out strictly in accordance with the previously aggreed plans.
Locks and bolts (other than of the panic action type) fitted to the external and internal doors on exit routes should be rendered inoperative in the open position during the whole time that the public are present on the premises.
All nosings to landings and steps to the exits, both internal and external, require maintaining so as to be conspicuous, by painting yellow or other suitable means, to provide a yellow or contrasting finish.
The use of padlocks and chains for additional security purposes on exit doors is permitted provided the locks and chains are removed prior to the public being admitted and are not refitted until the entire public have left the premises. The locks and chains should be placed on the notice board provided.
All electrical wiring should be protected to, and comply with approved standards for public entertainment premises as contained in the London District Surveyors Associations Model Technical Regulations for Places of Public Entertainment, the IEE Regulations and the requirements of Lancaster City Council.
Any temporary wiring or equipment for a specific function or discotheque must be under the control of a competent person who must ensure its safe erection, use, disconnection and removal after use. The name of the competent person shall be clearly displayed at the point of connection.
On each occasion of public entertainment, it is the licensee's responsibility to ensure that the maintained emergency lighting is switched on and in good order.
Application for consent for all decorations, curtains and hangings should be made to the licensing authority in writing and be unaccompanied by full details, including samples (not less than 200 x 150 mm) of the materials proposed to be used and, in the case of temporary decorations, a statement as to the period for which it is desired to retain the decorations.
All socket outlets or power supplies which are likely to be used for portable equipment shall be protected by residual current devices with a residual operating current not exceeding 30 ma and constructed to BS 4293:1983.
The licensing authorities consent is required before the use of smoke, pyrotechnics or other effects is permitted on the premises. At least ten days notice prior to intended use should be given.
At all times when the public is on the premises it should be the specific duty of at least one person to call the appropriate emergency services in the event of a fire or other emergency. Such persons should know the location of the nearest telephone and the nearest alternative telephone and be familiar with the method of using the emergency telephone system. The fire brigade must be called to each and every outbreak of fire however small. The premises shall be evacuated and no person shall re-enter the building until given permission by the Fire Officer in charge.
All portable electrical equipment, including that bought in by others, shall be tested for electrical safety at regular intervals. The date of testing shall be displayed on the equipment.
All equipment used in the area shall be appropriate to any external influences likely to be encountered.
Any music or P.A system used on the premises shall only be connected via a relay incorporated into to the fire alarm system which, in the event of an alarm, will cut off the music or P.A system so that the alarm is perceptible.
All persons engaged in controlling the security of the premises during the time that the public are present on the premises shall be registered under the door staff registration scheme operated by the Licensing Authority.
The premises shall be provided with a supply of drinking water, which is freely available.
Smoking and the use of naked lights of all kinds are strictly prohibited on stage.
The scenery and properties used on the stage/acting area should only be constructed of the following:
1) non-combustible material;
2) inherently flame retarded material;
3) timber, hardboard or plywood rendered flame-retarded by
an acceptable process of impregnation;
4) durably flameproof fabric;
5) timber framing not less than 22 mm thickness;
6) blockboard, plywood or chipboard not less than 18mm
minimum thickness; and
7) subject to special consideration by the Licensing
Authority, acceptable plastics material.
Fire test reports should be provided together with a sample of the material (300mm x 300mm) to this office. Additional samples should be available on site for testing by the authorities inspectors. Highly flammable and readily ignitable materials such as paper, cardboard, celluloid or cotton wool should not be used.
Colour filters for effects lighting etc. should comply with BS 3944:1992 and should also be given an additional test for flammability in accordance with BS 2782:Part 1:Method 140D:1980 or equivalents.
All scenery, draperies, backcloths, properties and decorations used should be either inherently flame retardant material or be rendered so by treatment with a fire retardant solution and maintained in this condition. Highly flammable and readily ignitable materials such as paper, cardboard, celluloid or cotton wool shall not be used. Evidence of such treatments should be provided to the Fire Officer and the Licensing Section of the Council.
At least ten days notice, in writing, shall be given to the Council of any intention to supplement the approved permanent stage or platform lighting and/or control apparatus with additional permanent or temporarily installed equipment, and the arrangements shall comply with such stipulations as the Council may consider necessary in any particular case. In the case of temporary installations the period for which it is desired to retain the installation should be stated. The work of installation shall be completed at least 24 hours before the first public performance.
Safety chains should be fitted at all times to any equipment, including stage lanterns, which is mounted at a height of over 2 metres above floor level.
Alterations or additions, whether permanent or temporary, to the structure, the lighting, heating or ventilation installations or to the seating, gangways or other arrangements at the premises. Shall not be made except with the prior approval of the Licensing Authority.
