Conditions consistent with operating schedule
1. A personal licence holder shall be on the premises after 8pm when alcohol is being sold or consumed, except in the case of an emergency
2. Whenever the designated premises supervisor is not at the premises another responsible person will be designated as the person responsible for alcohol sales and will have the contact details of the designated premises supervisor. The details of such person will be on prominent display.
3. Door supervisors registered with SIA shall be equipped with an appropriate method of keeping an accurate record of the capacity levels, including any separate capacity levels for individual rooms or levels
4. Door Supervisors shall be positioned at each entrance/exit (other than fire only exits) to ensure that no customer leaves with any bottles or glasses
5. The maximum number of persons (including staff) allowed to be on premises at any time shall be 840
6. No entry to or re-entry to the premises one hour prior to the terminal hour by members of the public or by any guests or friends of members of staff or the premises licence holder
7. The designated premises supervisor or a person nominated by them shall be a member of and regularly attend meetings of any Pubwatch scheme for the area within which the premises are located and would include registration and use of community/network radio
8. There will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
Conditions added after review of the licence
Thursday to Monday customers will not be allowed to leave the premises via the Dalton Square exit to smoke outside the premises after 23.00. Any customers wishing to smoke after 23.00 will leave the premises via the rear entrance on to St Marys Street.
From 23.00 on a Thursday to Monday door supervisors will be positioned by the Dalton Square entrance doors to ensure that customers are informed to smoke to the rear of the premises.
Thursday to Monday there will be at least one member of door staff that will monitor the external area on Dalton Square to ensure that customers are not smoking and re-entering the premises after 23.00.
Any customers that are smoking will be monitored to ensure they are not acting in a rowdy manner.
Doors and windows will be kept closed whenever there is regulated entertainment apart from access and egress.
Door supervisors will remain employed until the last customer has left the building and the immediate vicinity of the premises.
If requested, any person living in or around Dalton Square, will be provided with a contact number for management at the premises. This number will be available whenever the premises is open and will allow those residents to have direct communication with the venue.
Whenever regulated entertainment is taking place, regular assessments shall be made of any noise emanating from the premises. Wherever said assessments indicate that noise is likely to cause nuisance to any residents or businesses in the vicinity, steps will be taken to reduce the level of noise.
Any music that is played within the upper tier of the premises must be played through a sound limiting device.
Conditions amended following application to vary licence - April 2021
A comprehensive CCTV system shall be installed both internally and externally at the premises and will meet the following criteria:-
The system will display on any recording the time and date of said recording.
The system will be recording whenever the premises is open to the public.
Any recordings will be retained for a minimum of 31 days after they are made and will be produced to an authorised officer upon request, so long as said request is in accordance with the principles of the Data Protection Act or any subsequent or alternative legislation.
The CCTV will capture all public areas of the premises, with the exception of the toilets.
Appropriate signage alerting customers to the use of CCTV shall be displayed in a conspicuous position at the premises.
A competent person trained in the use of and operation of the CCTV will be in attendance at the premise at all times that licensable activities are taking place. Said person will be able to fully operate the CCTV system and be able to download data in a recognised format when requested.
Conditions added following application to vary licence - September 2022
DOOR STAFF CONDITIONS:
A minimum for 2 SIA registered door staff must be on duty for the first100 customers, followee by an extra one member of door staff for each additional 100 customers or part thereof from 2000 hours to close 7 days a week.
A written record shall be kept on the premises by the Designated Premises Supervisor of every preson employed on the premises as a door supervisor in a register kept for that purpose. That record shall contain the following details:
the door supervisors name, date of birth and home address
his/her Security Industry Authority licence number
the time and date he/she starts and finishes duty
the time of any breaks taken whilst on duty
All SIA door staff that work at this venue shall wear high visibility jacket
All SIA door staff that work at this venue will in 1 x BWV at the front and rear doors when on duty.
All SIA door staff that work at this venue shall will activate their BWV when dealing with any incident at the venue.
Any person(s) who is removed from the club, where possible, will be taken out via the Dalton Square side of the venue. If the person(s) is violent and it is not practicable then the person(s) should be removed via the rear exit.
Any memeber of SIA door staff who has been directly involved with an individual being ajjected should the step back inside ans another SIA doorstaff should replace them to avoid confrontation.
Prior to opening each day there will be a briefing with DPS (or manager on the night) , head of security, all staff and all security. This briefing will highlight roles and responsibilities of each staff and secutiy on duty, crime trends and any police INTL shared.
An incident book shall be maintained in which there will be recorded:
All incidents of crime and disorder.
Refused sales to suspected under-age and intoxicated persons.
A record of any persons asked to leave the premises.
Details of occasions in which the police were called to the premises.
A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion.
The book will be available for inspection by a police officer or authorised person on demand.
All private bookings shall be risk assessed by management.All records should be kept and any concerns passed on to Police Licensng. These records should be available for inspection by Police or any other Responsible Authority.
A Zero Tolerance approach to drugs will be promoted via appropriate signage in the premises. Any person found to be in the possession ofdrugs must be reported to the police immediatley upon being aprehended. Arrangements must be in place to include regular checks of toilet areas for drug use.
Allstaff involved in the provision of alcohol will successfully complete training in age related products prior to operating a till. Refresher training will also be successfully completed no more than every six months, this will be fully documented and available for inspection to police officers or other authorised persons.
Procedures are in place to make sure all staff are aware of their responsibilities in respect of serving alcohol and the relevant provisions of the Licensing act 2003. All staff are made aware of their responsibilities in respect of the sale alcohol and the potential problems that can occur if too much is consumed and the effec it can have on the behaviour of customers.As much as possible care is taken to ensure all customers are safe and do not create disorder when leaving the premises.
All glasses used at the venue will be made from polycarbonate, plastic or other non-glass alternative
Prevention of public nuisance
There shall be no furniture to the external area after 22:00 hours each evening which has a primary purpose of seating (such as chaser or stools).
Protection of children from harm
A Challenge 25 policy shall be adopted and enforced at the premises whereby any person that appears to be under the age of 25 shall be required to provide identification to prove that they are over the age of 18 before they are permitted to purchase alcohol. The only forms of acceptable identification will be:-
A Passport
A UK Photocard Driving Licence
Official ID card issued by HM Forces or EU bearing a photograph and date of birth of the holder
Any other form of identification agreed with a representative of the Police Licensing Unit.
All staff who are involved in the sale of alcohol will be trained in relation to the "Challenge 25" policy upon commencement of their employment, following which they will undertake refresher training at least once every twelve months. Said training will be documented and will be made available to an authorised officer upon request.
