  Mandatory conditions

  No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

  The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

   

  The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  In this paragraph, an irresponsible promotion means any one or more of the following activities, or

  substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or

  contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children:

   

                              (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to:

                                            (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

                                            (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

                              (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

                              (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

                              (d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

                                            (i)              the outcome of a race, competition or other event or process, or

                                            (ii)              the likelihood of anything occurring or not occurring

                              (e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  The premises licence holder or club premises certificate holder shall ensure that an age

  verification policy applies to the premises in relation to the sale or supply of alcohol.

   

  The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  The responsible person shall ensure that:

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

                              (i)              beer or cider: ½ pint;

                              (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii)              still wine in a glass: 125 ml; and

  (b)              customers are made aware of the availability of these measures

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  There should be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children

• Offered Conditions

   

  Prevention of Crime and Disorder

   

  1.              The venue must obtain, maintain and use at all times that the venue is operating a Community Link Radio.  This must be charged and ready for use when the venue is open.  Unless in the case of an emergency or the unit is broken.  If the unit is broken this fact must be reported to Police immediately

  2.              The must install, operate and maintain a CCTV system, that is capable of storing images for at least 14days and is capable of providing clear images of persons within the venue.

  3.              There must be a member of staff on duty, at all times that the venue is open that is capable of downloading the CCTV and be able to provide footage in a removal format to police

  4.              There must be at least one CCTV camera at the front entrance to the venue, one in the main entrance stairwell, one displaying the main bar area, one in the main snooker/pool hall and one covering any area used for the provision of the consumption of drinks

  5.              At least 1 x SIA registered door security officer must be on duty from 9pm till close every Friday and Saturday evening.  An additional door supervisor must be on duty from 2200hrs every Friday and Saturday, until close.

  6.              At least 1 x SIA registered door security officer must be on duty during which a private function is held at the venue after 6pm daily. (this does not include a function whose sole purpose is a snooker or pool tournament)

  7.              At least 2 x SIA registered door security officers must be on duty on New Years Eve from 2100hrs until close

  8.              The DPS must maintain a clear venue incident book, which will include the start and finish times of any SIA officer, details of all incidents involving crime/disorder, refusal due to age, refusals due to drunkenness and any other matters of note

  9.              The DPS must be on duty at the venue every Friday and Saturday evening from 2100hrs onwards, unless in the case of an emergency, whereby a person nominated by the DPS will carry out the function of DPS.  In these cases, the acting DPS must display their details in full view of the public at the main bar area.  The acting DPS must have contact details for the DPS

  10.              All sales of alcohol made on Friday and Saturday from 1800hrs must be made by a Personal Alcohol Licence holder.

  11.              A Personal Alcohol Licence Holder, must be present at the venue at all times that alcohol is consumed on the premises

  12.              The venue must introduce and maintain a clear written policy in relation to drugs and drug misuse and this must be available for inspection by Police at all times

  13.              A representative from Rio’s must attend all Pub-watch meetings on a regular basis.  If the venue refrains from becoming a member of a pub-watch scheme, or is excluded by such a scheme, a full written disclosure must be made to Police within 7days, clearing stating the reason why Rio’s in not part of Pub-watch

   

  Public Safety

   

  1.              Any SIA door staff engaged on such duties will wear a high visibility jacket or tabard

  2.              The main snooker or pool areas and any side room used for such an activity will not be permitted to be used as a dance floor area

  3.              All snooker and pools cues must be safely stored in wall racks or in such other manner, when not in use

   

  Protection of Children from Harm

   

  1.              No person under the age of 18 will be permitted within the venue after 8pm daily

  2.              All staff will receive initial age awareness training upon appointment and then receive refresher training every three months.  This training must be written and signed by the member of staff and the DPS and be kept for inspection at all times by any person wishing to so inspect the documents

  3.              The venue will introduce and clearly advertise a ‘challenge 25’ policy in relation to the sale of alcohol

  4.              ‘Challenge 25’ posters must be clearly displayed at the point of entry to the venue and repeated throughout the venue, with clear signs at the point of sale of alcohol

  5.              The venue will only accept Passport, Photo-card Driving Licence or a Identity card bearing the PASS hologram as acceptable forms of proof of age

  6.              The venue must maintain a refusals book in relation to age challenges.  This refusals book must be inspected by the DPS monthly and be available for inspection by Police if required

   

  Public Nuisance

   

  1. All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency
