Conditions Consistent with the Operating Schedule
The designated premises supervisor shall wherever possible have at least two years experience of managing similar premises with a similar capacity and with a similar terminal hour
A personal licence holder shall be on the premises at all times during which alcohol is being sold or supplied to customers or consumed by customers except in the case of an emergency
Whenever the designated premises supervisor is not at the premises another personal licence holder will be nominated by the designated premises supervisor as being the responsible person to manage the premises and will have the contact details of the designated premises supervisor. The details of such person to be on prominent display outside the premises
When the premises are open for business a minimum of 2 door staff shall be deployed to cover the front door AT ALL TIMES. In addition when the first floor is open (but only when this specific floor is open) a minimum of 2 door staff shall be deployed to cover the first floor area and when the second floor is open (but only when this specific floor is open) a minimum of 4 door staff shall be deployed to cover the second floor area. All door staff shall wear high visibility orange or yellow reflective jackets both inside and outside the premise.
If at any time the venue capacity raises above 700 persons, an additional 1 x SIA registered door staff officer must be on duty for every part of 100 persons, until capacity is reached (1100)
Four door supervisors registered with the SIA will remain outside the premises until at least 15 minutes after the last customer has left the premises
Door supervisors registered with SIA shall be equipped with an appropriate method of keeping an accurate record of the capacity levels, including any separate capacity levels for individual rooms or levels
Door Supervisors shall be positioned at each entrance/exit (other than fire only exits) to ensure that no customer leaves with any bottles or glasses
Door supervisors will patrol the queue to the premises as necessary but no less than once every 5 minutes to ensure that customers who are drunk or who have acted in a disorderly manner, or have behaved in such a way as to cause a public nuisance or disturbance, are prevented from entering the premises
The designated premises supervisor will maintain a daily record comprising of the following: - Start time and finish time of each door supervisor. The door supervisor will record their SIA badge number and will sign and print their name in a legible form at the beginning and end of each tour of duty. The record shall be kept securely on the premises for at least 6 months and shall be produced on request to the police or other authorised person
Serious consideration will be given to any crime prevention survey and a risk assessment will be produced to justify any item of non-compliance
To install, maintain and operate a CCTV system which complies with the minimum requirements expected of the Lancashire Constabulary and shall record during all hours that a licensable activity takes place on the premises
A dispersal policy which is agreed by the police to be implemented at all times
Any person who looks or appears to be under the age of 18 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: UK photo driving licence; Passport; PASS card (proof of age standards scheme)
The maximum number of persons (including staff) allowed to be on premises at any time shall be 1100
No entry to or re-entry to the premises one hour prior to the terminal hour by members of the public or by any guests or friends of members of staff or the premises licence holder
The premises licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend meetings of any Pub watch scheme for the area within which the premises are located and would include registration and use of community/network radio
The premises licence holder will provide to the police a drugs policy for the premises which shall as a minimum contain all of the best practices outlined in the guidance published by the Home Office and the London Drug Policy Forum ‘Safer Clubbing’
Door supervisors and other members of staff to request customers to leave quietly and have respect for their residential neighbours
No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises
Save for main doors when being used for customer admission and exiting and those to the external area, all external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency
The premises licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action
There is an automatic noise-limiting device in the main room, this will be utilised as a condition. The smaller room does not have an automatic noise-limiting device but one will be installed should it be deemed necessary following consultation between venue management and officers from the Lancaster City Council Noise Protection Team. The premises licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action
One member of door staff to remain on the terrace area at all times whilst the premises is open for licensable activity
No bottles, glasses or drinks to be taken onto the terrace area at any time, whilst the premises is open for licensable activity
All drinks to be served in polycarbonate vessels with the exception of sparkling wines and champagnes in the VIP room, which can be served in their original glass bottles, however, the drinking vessels (champagne flutes), must be polycarbonate.
No amplified music to be played on the smoking terrace
Double doors opening to smoking terrace to be fitted with self-closers and not fixed open
Vertical balustrade to be used in place of horizontal in respect of the balcony with a toe board at ground level
There will be no adult entertainment services, activities other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
This venue will continue to comply with all of the conditions on the justices licence, public entertainment licences and other licences in force for the additional hours (in so far that they are not being varied by this application). The Public Entertainment Licence guidelines are specific to this venue, its location and style of operation. The venue has an established capacity.
If a DJ is used on any night then he/she will ask customers to leave quietly.
The current level of lighting outside the premises will continue for the additional hours of trading.
Notices stating that CCTV is in operation 24 hours a day will be displayed throughout the venue.
Any person who appears to be intoxicated or who is behaving disorderly will not be allowed entry to the venue. Any person within this venue who appears to be intoxicated or who is behaving disorderly will be given care and consideration in leaving the venue.
A person trained in first aid will be at the venue who will have received training in any problems associated with alcohol and drug misuse.
A qualified first aider shall be present throughout any sporting entertainment involving boxing, wrestling, judo, karate or sport of a similar nature.
Where a ring is used it will be constructed by a competent person and shall be inspected by a competent authority before use and any material used to form the skirt of the ring shall be fire retardant.
The seating layout shall be agreed with the appropriate authorities.
Reasonable steps will be taken to recognise the need of local residents and businesses.
A person under the age of 18 will only be permitted to visit the venue with a responsible adult usually for the purpose of dining unless there is an event especially organised for the youth market.
Unaccompanied persons under the age of 18 are not welcome in the venue except at events especially organised for the youth market.
A person under 18 years will not be allowed to use any AWP machine.
When the venue holds specially organised events for the youth market the venue will adhere to the following documentation which is lodged with the licensing department at Lancaster City Council:-
Admission policy;
General Policies Statement;
Code of Conduct for Staff Statement and
Child Protection Policy.
