Conditions as per Operating Schedule
The Prevention of Crime and Disorder
1. An incident log (which may be electronic) will be maintained in which there will be recorded:
(a) All incidents of crime and disorder
(b) Refused sales to suspected under-age and drunken persons.
(c) A record of any person asked to leave the premises.
(d) Details of occasions on which the police are called to the premises.
(e) A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion.
2. The log will be available for inspection by a police officer or authorised person on request, in line with Data Protection legislation.
3. All staff involved with the provision of alcohol will successfully complete training in age related products prior to operating a till and suitable training with regard to serving drunks. Refresher training will also be successfully completed not more than every 6 months. Training documents (which may be in an electronic format) will be made available for inspection to police officers or other authorised persons, in line with Data Protection legislation
4. Procedures are in place to ensure all staff are aware of their responsibilities in respect of serving alcohol and the relevant provisions of the Licensing Act 2003. All staff are made aware of their responsibilities in respect of the sale of alcohol and the potential for problems that can occur if too much is consumed and the effect that can have on the behaviour of customers. As much as possible care is taken to ensure all customers are safe and do not create disorder when leaving the premises.
5. Frequent collection of drinking vessels will be undertaken to ensure that empty containers do not accumulate in or around the Licensed Premises.
6. CCTV equipment shall be installed and be maintained in good working order in accordance with the manufacturer's instructions. Training should be provided for staff members in the usage of the CCTV equipment. CCTV footage recorded must, as a minimum, cover each entry/exit point of the premises and be recording at all times when the premises is conducting licensable activities.
7. The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days.
8. The Data Controller will make footage available within a reasonable time to a Police Constable or Authorised Officer, where such request is made in accordance with and which satisfies the Data Protection Act 1998.
9. Every Friday and Saturday evenings a minimum of 2 SIA registered door staff must be on duty for the first 100 customers from 22:00 to close (whose primary duty will be to cover the entrance door) followed by an extra one member of door staff for each additional 100 customers or part thereof with that extra additional door staff maintaining presence inside the premises.
From Sunday to Thursday SIA registered door-staff will be used on a risk-assessed basis by management.
10. A written record shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor in a register kept for that purpose. That record shall contain the following details:-
a) the door supervisor's name, date of birth and home address
b) his/her Security Industry Authority licence number
c) the time and date he/she starts and finishes duty
d) the time of any breaks taken whilst on duty
11. All private bookings should be risk assessed by management. Records of the booking should be kept and any concerns passed to Police Licensing. These records should be available for inspection by Police or any other responsible authority, in line with Data Protection legislation.
12. A Personal Licence Holder must be on duty at all times the premises is open for licensable activities except in the case of an emergency.
13. Another member of staff shall be nominated to act for the DPS in their absence whose identity is known by all staff when such absence occurs.
14. The provision of off-sales are to terminate at 23:00, this applies to genuine off-sales and not customers taking drinks to any external area associated with the premises designated for the purpose of consumption.
15. A zero tolerance approach to drugs will be promoted via appropriate signage in the premises. Any person found to be in possession of drugs must be reported to the police immediately upon being apprehended.
16. There will be no adult only entertainment provided in the down-stairs of the venue.
17. Regular hourly toilet checks to be carried out and recorded to discourage drugs taking or drug dealing activity.
18. Where there is reasonable suspicion that drugs are being carried , the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex in full view of the CCTV.
19. Clearly visible notices shall be displayed advising those attending that:
It is a condition of entry that customers agree to be searched and Police will be informed if anyone is found in possession of controlled substances or weapons.
20. Confiscated and found drugs shall be transferred to the Police in accordance with procedures agreed with Lancashire Constabulary.
21. No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery or following re-entry from any external area of the premises.
22. Adequate first aid provision is available at all times the premises are being operated.
23. The Licence holder/DPS shall arrange adequate supervision of any queue which may form to gain entry to the premises.
24. The Licence holder shall erect and maintain suitable and sufficient conspicuous signage on the exterior of the premises advising patrons that causing any disturbance or disorder in a queue will result in admission being refused.
25. No boxing machines to be in operation in the premises.
26. The premises shall maintain a written dispersal policy and will be made available for inspection on request to the Police or responsible authority.
27. There shall be no new entry to the premises for customers after 0300 hours on any day (save for re-entry for existing customers who have temporarily left the premises for example to smoke).
Public Safety
We understand our obligations under existing legislation and take our responsibilities seriously.
The Prevention of Public Nuisance
28. Notices will be displayed at the entrance and exits advising customers to leave quietly.
29. The departure of customers from the premises shall be effectively managed by staff who will request patrons to leave quietly and to avoid causing noise, nuisance or disturbance in the area.
30. The volume of amplified sound used in connection with entertainment shall at times be under the control of the licensee or management and the volume control shall be operated from a part of the premises inaccessible to the public.
The Protection of Children from Harm
31. A documented Challenge 25 scheme will be operated at the premises. The Challenge 25 scheme shall be actively promoted and advertised at the premises and will ensure that any person purchasing alcohol, who appears to be under 25 years of age, shall be asked to provide acceptable identification to prove that they are 18 years of age or over. Failure to supply such identification will result in no sale or supply of alcohol to that person.
32. The Proof of Age Standards Scheme (PASS) will be actively promoted at the premises by the display of Challenge 25 posters bearing the PASS logo.
A PASS accredited holographic proof of age card will be the main identification document accepted at the premises as proof of age. A PASS card must be accepted as proof of age if a purchaser possesses one. Where a purchaser does not possess a PASS accredited proof of age card, only the following alternative forms of alternative identification will be acceptable:-
(a) Photo driving licence
(b) Passport or
(c) Her Majesty’s Forces Warrant Card
Suitable signage will be displayed to specify the Challenge 25 policy is in place.
33. A log (which may be electronic) shall be kept detailing all refused sales of alcohol. The log shall include the date and time of the refusal and the name of the member of staff who refused the sale. A copy of the log or electronic report shall be made available to an Authorised Police Officer and Licensing Authority Officer upon request.
