Conditions consistent with operating schedule
General
The aim of this application is to create an overall events space, with smaller events areas, which has the flexibility to accommodate a varied number of different forms of entertainment and events. The premises has been used successfully over the last years for small events and has recently been used for a three week long first for Morecambe, The Fear Factory. The Fear Factory is a Halloween inspired event to scare and excite attendees and is family friendly. These are all the type of events that would be covered under the premises licence application.
The premises incorporates two buildings, the Hitchin Building and the old B&M Bargains Store. It is adjacent to the applicants existing businesses, Soul Bowl, Johnnys and Johnny’s Amusements. For occasional. We had previously discussed the use of the large car park at the rear, but this is no longer part of the scheme. Conditionality can be offered in terms of number of uses and notice periods to incorporate advice, meetings and SAG’s where necessary. Conditionality can also be offered around particular forms of entertainment.
The aim of the application is to cover the gap soon to be left by the repurposing of the council’s site which is opposite, and to give this building a purpose and use for the next three to five years whilst the development of The Eden Project, Morecambe seafront and various infrastructure projects is taking place. The use of the buildings then might change as the character of the Seafront changes and tourism increases and develops.

More Permanent Uses incorporated within the scheme
B & M Bargains would be used for Laser Tag. Both the ground and first floor could be used, with different battle areas constructed on the floors. Both floors would be constructed with portable/movable landscape items such as inflatables or items that can be wheeled to the side. The reason for this is to allow the ground floor to be used as an overflow event space. This would operate in conjunction with the Hitchins building for larger events, or small weekend festivals. The Hitchin building would have a permanent event space on the ground floor with the possibility of crazy golf on the first floor. The golf course would be a fairly permanent installation, and is something we are currently investigating. Both the Laser Tag and the Crazy Golf would add to the facilities already offered on site by Johnny’s Entertainment Centre, and would be destination events for families or groups. As part of this application there will be a connection made between Johnny’s and the Hitchins building to allow for customers to pass between the premises and to obtain drinks and food and toilets. Accordingly the Soul Bowl Licence will be varied
to include the new access in due course (subject to grant, of course).
Food
There are no plans to have food concessions inside, other than inside marquees or under the walkway between the two buildings. Food providers will either be one of the concessions operated by the licence holder or contractors ‘hiring a pitch’ for a particular event. There will be snacks on offer inside B&M for lazer tag users, but this is all that is planned currently.
Bars and Service
Bars within the ground floor premises and outside will be mobile. Some of the larger bars inside may stay within the same area, but can be moved depending upon the event or events taking place at the premises. Most drinks from the bars will be served in plastic containers during events. This will not be the case for Laser Tag and crazy golf. This will be on a risk assessment basis. Exceptions might include service into seated areas, as compared to drinks taken into events/gigs or outside into designated areas or the outdoor area. Where drinks are sold in non-plastic containers they will be restricted to a particular
area, for example the Lazer Tag area has an area for seating etc.
Conditions agreed with Lancashire Constabulary
For all Licensable Activities the following will apply to ALL events:
1. A documented Challenge 25 scheme will be operated at the premises. The Challenge 25 scheme shall be actively promoted and advertised at the premises and will ensure that any person purchasing alcohol, who appears to be under 25 years of age, shall be asked to provide acceptable identification to prove that they are 18 years of age
or over. Failure to supply such identification will result in no sale or supply of alcohol to that person.
2. The following alternative forms of identification will be acceptable:
(a) Photo driving licence
(b) Passport or
(c) HM Forces Warrant Card
3. An incident record will be maintained in which there will be recorded:
1. All incidents of crime and disorder
2. A record of any person asked to leave the premises.
3. Details of occasions on which the police are called to the premises.
4. A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion.
5. A record will be kept of refusals of sales of alcohol to persons who appear to be underage (in accordance with Challenge 25) and of persons who are drunk. That record will be available for inspection by the Police and the Licensing Authority upon lawful
request. The record will be available for inspection by a police officer or
authorised person on lawful request.
4. All staff involved with the provision of alcohol will successfully complete
training in age related products prior to completing a sale. Refresher training will also be successfully completed not more than every 12 months, this will be fully documented and be available for inspection to police officers or other authorised persons. upon lawful request.
5. CCTV equipment shall be installed and be maintained in good working order in accordance with the manufacturer's instructions. Training should be provided for nominated staff members in the usage of the CCTV equipment. CCTV must, as a minimum, cover each entry/exit point of the premises and be recording at all times when the premises is conducting licensable activities.
6. The images recorded by the CCTV system shall be retained in unedited
form for a period of not less than 31 days.
7. The Data Controller will make footage available within a reasonable time to a Police Constable or Authorised Officer, where such request is made in accordance with and which satisfies the Data Protection Act 1998.
8. No persons under the age of 18 shall be employed on the premise in
relation to the selling of alcohol.
9. No person under the age of 21 will be allowed to organise or book a private function at the premises, such as birthdays, christenings, wedding receptions or similar. This shall not include events involving an activity such as laser tag or mini golf.
10.No unaccompanied children are allowed on the premises, except where they are there for the purposes of attending activities such as laser tag or mini golf. Any persons under the age of 18 must otherwise be accompanied by a parent/guardian/person over 18 years of age.
11.A zero-tolerance approach to drugs will be promoted via appropriate signage in the premises. Any person found to be in possession of drugs must be reported to the police immediately upon being apprehended.
12.At all times that the premises is open to the public then there should be
regular toilet checks conducted and documented accordingly. These checks will be done at regular intervals.
13.Management will work closely with Police and Morecambe Pub watch scheme to ensure they are aware of any known drug dealers and activity in the area to prevent entry to the premises for ALL events.
14.Any requirement for SIA Door Staff to be done on a risk assessment basis (unless specified for Music Festivals or DJ events see below) such as:
a. St Patrick’s Day, Bank Holidays, last Friday before Christmas known as ‘Black Eye Friday’, any showing of major sporting events including Boxing, Football (World Cup, European Championships, Premier League), Wrestling etc; and
b. Where there is information from Police where security is needed such as a wake, funeral or high tensions in the area and community. The manager in charge must risk assess these events and have in place sufficient SIA door staff cover to manage the premises and ensure the Licensing Objectives are being promoted. Whilst the premises licence permits boxing or wrestling as regulated entertainment, this is only to permit ‘Professional Wrestling’ and not Boxing.
For any ‘Music Festivals’ held in the building the following extra conditions will apply:
15.The organiser must give at least three months’ notice to the local authority, residents (via social media) and the Emergency Safety Advisory Group (ESAG) of the proposed Event.
16.The organiser must attend at least one ESAG meeting held prior to the Event.
17.The licensee or nominated event organiser must complete a full Event Safety Management Plan (ESMP) prior to each Event. The ESMP must be approved by the ESAG at least one month prior to the event. Any changes requested to be made to the ESMP after its approval by ESAG, must be approved by the Licensing Authority. The ESMP must include, but not be limited to, the following (as guidance):
1. Introduction and Event Overview including details of proposed entertainment

4. Organisational Structure, Roles & Responsibilities
5. Crowd Management Plan including plans for access, egress, dispersal and evacuation

21. The organiser will produce a detailed, scaled draft site plan which will include, but not be limited to, all entrances and emergency exits, first aid and welfare points, fire points, temporary bars, kitchens, staging, structures,marquees and sanitary provision. The draft site plan will be discussed within ESAG and when agreed it will form part of the ESMP.
22. The ESMP will form the framework within which the event is managed and operated - the conditions and operating procedures defined in the final version of the ESMP will be adhered to.
23. After each Event, a debrief will be held with ESAG representatives.
24. Access to the event for members of the public will be predominantly by ticket only. Staff, artists, trader, supplier and contractor access will only be allowed on display of relevant accreditation. Accreditation will be issued and managed by the event organiser.
25. The licence holder will employ the services of a recognised and qualified security and stewarding company. This company will provide their own security, stewarding and crowd management plans which will form part of any ESMP. The security provider will be discussed with the Police in advance of the Music Festival.
26. The licence holder will work closely with the Security Ops Manager and implement their recommendations on security and numbers needed dependent on any given event. A minimum of 2 SIA registered door staff must be on duty for the first 100 customers from the start of each event (each event may differ on start times) to close followed by an extra one member of door staff for each additional 100 customers or part thereof. Extra door staff may be required for larger events and are conditioned specifically under each heading.
27. All SIA registered door staff that work at this venue will wear high visibility jackets / vests.
28. All SIA registered door staff that work at this venue will have at least 1 x BWV at the front and rear doors when on duty.
29. All SIA registered door staff that work at this venue will activate their BWV when dealing with any incident at the venue.
30. Any person(s) who is removed from the venue, where possible, will be taken out via the Marine Road, side of the venue. If the person(s) is violent and it is not practicable then the person(s) should be removed via the nearest exit.
31. Any member of SIA door staff that has been directly involved with an individual being ejected should then step back inside and another SIA door staff should replace them to prevent confrontation.
32. All security staff and stewards will be easily identifiable and have appropriate training for their duties. A register will be maintained of all stewards and security staff employed before, during and after the Event containing their full names, date of birth, home addresses, employers, event specific identification and where appropriate their SIA registration details (see next condition).
33. These details will be made available to Lancashire Police and the Licensing
Authority on lawful request.
34. All patrons will be subject to a search as a condition of entry, a discrete search area will be provided. Anyone refusing a search will be denied entry to the licensed premises and will not be eligible for a refund of ticket price.
35. Each bar on site will be managed by a personal licence holder under the site DPS. A refusal log will be kept at each bar.
36. The organiser will take all reasonable steps to prevent drunkenness and other disorderly conduct.
37. The organiser will prepare a drugs policy for each Event, which will be approved by the Lancashire Police Authority one month prior to the Event.
38. A copy of the premises licence and its conditions will be available for inspection at all times.
39. No glass containers or glass bottles shall be sold on the Licenced Premises. The event organiser shall take appropriate measures to prevent glass containers or glass bottles being brought on to the premises by the public during this event.
40. As a condition of entry all persons under the age of 18 must be accompanied by an adult.
41. The maximum number of people at an Event will be limited to 1200 in the Hitchins building and 878 for the B&M buildings, with 2078 for events including the ground floor of both the Hitchins and B&M buildings. This is to include all personnel on site as well as ticket holders.
42. Any area used at the entrance exit for patrons waiting for taxis should have SIA door staff cover to manage the patrons and prevent any crime or disorder.
For any ‘DJ events’ held in the building the following extra conditions will apply:
43. A minimum of 2 SIA registered door staff must be on duty for the first 100 customers, followed by an extra one member of door staff for each additional 100 customers or part thereof from opening time of event to close for each event.
44. A written record shall be kept on the premises by the Designated Premises
Supervisor of every person employed on the premises as a door supervisor in a register kept for that purpose. That record shall contain the following details:
• the door supervisor's name, date of birth and home address
• his/her Security Industry Authority licence number
• the time and date he/she starts and finishes duty
• the time of any breaks taken whilst on duty
45. All SIA registered door staff that work at this venue will wear high visibility jackets or vests.
46. All SIA registered door staff that work at this venue will have at least 1 x BWV at the front and rear doors when on duty.
47. All SIA registered door staff that work at this venue will activate their BWV when dealing with any incident at the venue.
48. Any person(s) who is removed from the venue, where possible, will be taken out via the Marine Road side of the venue. If the person(s) is violent and it is not practicable then the person(s) should be removed via the nearest exit.
49. Any member of SIA door staff that has been directly involved with an individual being ejected should then step back inside and another SIA door staff should replace them to prevent confrontation.
50. Prior to opening on each day there will be a briefing held with DPS (or manager on the night), head of security, all staff and all security. This briefing will highlight roles and responsibilities of each staff and security on duty, crime trends and any Police INTL shared.
51. An incident book will be maintained in which there will be recorded:
1. All incidents of crime and disorder
2. A record of any person asked to leave the premises.
3. Details of occasions on which the police are called to the premises.
4. A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion.
52. The book will be available for inspection by a police officer or authorised person on demand.
53. A zero-tolerance approach to drugs will be promoted via appropriate signage in the premises. Any person found to be in possession of drugs must be reported to the police immediately upon being apprehended. Arrangements must be in place to include regular checks of toilet areas for drug usage.
54. All glasses used at the venue will be made from polycarbonate, plastic or other non-glass alternative.
55. Any area used at the entrance exit for patrons waiting for taxis should have SIA door staff cover to manage the patrons and prevent any crime or disorder.
56. No persons under the age of 18 years of age will be allowed on the premises
during this event.
