Offered Conditions
1. A personal licence holder shall be on the premises at all times from 20.00 hours daily during which intoxicating liquor is sold/supplied to customers or consumed by customers, except in the case of an emergency
2. Non standard timings. On no more than 15 occasions per calendar year, these extensions for the supply of alcohol can only take place if at least 10 days notice is provided to police and the licensing authority and only if the police give their consent.
3. On Friday/Saturday and Saturday/Sunday 3 SIA registered doorstaff will be on duty from 22.00 hours to 06.00 hours
4. The maximum number of persons (including staff) allowed to be on premises at any time shall be 360 (160 on the ground floor and 200 on the first floor)
5. There will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children
6. No loudspeakers to be operated in balcony area
7. Staff to be present to maintain order and prevent unruly behaviour
8. Doors connecting balcony area to nightclub to be kept closed and fitted with self-closing mechanisms.
OPERATING SCHEDULE
a) General - all four licensing objectives (b,c,d,e) (please read guidance note 9)
1) All staff and management are trained in the promotion of the main criteria of the Licensing Act 2003 in respect of (b) - (e) below.
b) The prevention of crime and disorder
1 No drinks offers at less than £1.
2 Active members of the Local Pubwatch scheme.
3 Text/radio pagers connecting premises to the local Police so that a rapid response can be made by the police/potential troublemakers can be refused entry. The text/pager equipment to be kept in working order at all times - DPS/ licence holder to be responsible for the pager at all times.
4 Crime prevention notices to be displayed prominently on the premises, for example a warning not to leave bags unattended etc.
5 The designated premises supervisor shall have at least 2 years experience of managing similar premises in a similar capacity.
6 Whenever the designated premises supervisor is not on the premises another personal licence holder will be nominated by the designated premises supervisor as being the responsible person to manage the premises and will have the contact details of the designated premises supervisor, the details of such person to be on display outside the premises.
7 All door staff to be S. I. A. registered.
8 Door supervisors registered with the S. I. A shall be equipped with an appropriate method of keeping account of capacity levels, including any separate capacity levels for individual rooms or levels.
9 Door supervisors shall be positioned at each entrance/exit (other than fire only exits) to ensure that no customer leaves any bottles or glasses or food in any container or wrapper.
10 The designated supervisor will maintain a daily record comprising the following: - start time and finish time of each door supervisor. The door supervisor will record their S. I. A. badge number and will sign and print their name in a legible form at the beginning and end of each tour of duty. The record shall be kept securely on the premises for at least 6 months and shall be produced on request to the Police or other authorised person.
11 To install, maintain and operate a CCTV system which complies with the minimum requirements expected of the Lancashire Constabulary and shall record during all hours that licensable activity takes place on the premises.
12 A dispersal policy, which is agreed by the Police, to be implemented at all times.
13 Any person who looks or appears to be under the age of 18 shall be asked to provide identification to prove that they are over 18. The following are the only forms of identification acceptable: - UK photo driving card, Passport, PASS card (proof of age standards scheme).
14 A crime prevention survey is to be undertaken by the Police and their recommendations fully complied with prior to the variation taking effect.
15 The premises licence holder will provide to the police a drugs police for the premises, which shall, as a minimum, contain all of the best practices outlined in the guidance published by the Home Office and the London Drug Police Forum on ‘Safer Clubbing’.
16 Free drinking water to be made available at all times at the bar.
17 No entry less than 45 minutes before the terminal hour.
18 Off sales will cease at 11p.m. daily.
19 On Fridays and Saturdays the capacity will not be reduced provided that there are a minimum of one doorstaff on duty per hundred customers between 2 a.m. and 6 a.m.
20 On Friday/Saturday and Saturday/Sunday there will be 3 SIA registered doorstaff on duty from 22:30 hours to 06:00 hours.
21 On Sunday - Wednesday there will be a minimum of 1 SIA registered doorstaff on duty from 22:30 hours, if the unit is trading after 01:00 hours.
22 On Thursday there will be a minimum of 2 SIA registered doorstaff on duty from 22:30 hours, during student term time and a minimum of 1 SIA registered doorstaff on duty from 22:30 hours outside of student term time if the unit is trading after 01:00 hours.
c) Public Safety
1. Daily Safety audit to be carried out and log book to be maintained.
2. A first aid box on the premises and a first aider on the premises.
3. Fire extinguishers on the premises.
4. Fire exits clearly signed.
5. Emergency lighting.
6. Fire escapes.
7.Smoke alarms/ heat detectors.
8.Annual check to be allowed by the relevant bodies to ensure all safety features and measures are being complied with.
9.Capacity limit of 360 set.
10. No person to be allowed access to the premises 45 minutes before closing.
11. No drunk, unruly or disorderly people to be allowed entry to the premises.
12. Dress code policy.
13. Emergency exits will remain unobstructed at all times.
14. Hangings, curtains and temporary decoration are maintained in a flame-retardant condition.
15. To install, maintain and operate a CCTV system which complies with the minimum requirements expected of the Lancashire Constabulary shall record all hours that a licensable activity takes place on the premises.
d) The prevention of public nuisance
23 Bottle skip to be emptied during the day.
24 Sign placed above the door asking customers to leave quietly.
25 Calling taxis for customers to ensure that they are moved off the premises quickly and quietly.
26 Steps will be taken in order to minimise any smells coming from the premises, in particular from the kitchen.
27 French windows to the front of the premises to be locked shut at 10.00 p.m.
28 Rear balcony area to be de-licensed from 11 p.m. but to be allowed for the use of smoking. Numbers to be strictly monitored and noise to be kept to a minimum. Staff and signage to be advised accordingly.
29 No music will be played on the rear balcony area.
30 Acoustic Consultants are to be engaged to survey the premises and reset the noise-limiting device incorporated on the amplification system. This work is to be carried out within one month of being requested by Lancaster City Council.
e) The protection of children from harm
No admittance to under 18s unless as part of a private function in a separate room. In this instance always accompanied by an adult and it will be part of a properly organised function.
