• Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

   

  Mandatory condition where Door Supervisors are provided

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory condition where the licence permits the performance of Films

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the filmMandatory Licensing Conditions

   

  1.              (1)              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children:

   

                              (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to:

   

                                            (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                                            (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

   

                              (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

                              (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

                              (d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

   

                                            (i)              the outcome of a race, competition or other event or process, or

                                            (ii)              the likelihood of anything occurring or not occurring

   

                              (e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2.              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3.              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  4.              (1)              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

                (2)              The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5.              The responsible person shall ensure that:

   

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

   

                              (i)              beer or cider: ½ pint;

                              (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii)              still wine in a glass: 125 ml; and

   

                (b)              customers are made aware of the availability of these measures.

   

   

   

   

• Non standard timings

   

  1        The open areas of the park may, in practice, be open to the public 24 hours a day but licensable activities within the open areas of the park will take place under this licence only between 10.00 hours and 23.00 hours

  2.   On New Year’s Eve alcohol may be sold from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day

• Offered Conditions

   

  1        The premises licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.  A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action

  2        Ten days advance notice in writing of any intended sale of alcohol within the open areas of the premises (i.e. other than in the Ashton Memorial or in the Pavilion Café) will be given to the Police and the Head of Health and Strategic Housing of Lancaster City Council

  3        Sales of alcohol made in either the Ashton Memorial or the Pavilion Café but appropriated to the contract elsewhere within the premises shall be deemed to have taken place at the point of sale

  4        Ten days advance notice in writing of any intended regulated entertainment will be given to the Police and the Head of Health and Strategic Housing of Lancaster City Council

  5        All outdoor (i.e. other than in the Ashton Memorial or in the Pavilion Café) licensable activities will conclude at 23.00 hours

  6        The provision of late night refreshment is limited to the Ashton Memorial and Pavilion Café and their respective curtilages (i.e. the areas immediately adjoining the Ashton Memorial and the Pavilion Café)

  7        No more than 4999 persons (including staff etc.) will be on the premises at any one time

  8.   There will be no adult entertainment services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children

   

  Operating Schedule

  The prevention of crime and disorder

   

  The conditions below are intended to deal with crime and disorder issues:

   

  1.              To permit all licensable activities, excluding boxing and wrestling indoors or outdoors and excluding late night refreshment outdoors apart from upon the curtilages of the Ashton Memorial and the Pavilion Café, to be undertaken at any location within Williamson Park edged red on plan number 9046/001 attached provided that if any licensable activity is to take place at any location within the said area edged red on plan number 9046/001 other than within the Ashton Memorial and its cartilage or the Pavilion Café and its cartilage within Williamson Park then the Premises Licence Holder will give ten days advance notice to the Police and to the Environmental Health Officer, Head of Health and Strategic Housing, Morecambe Town Hall, Morecambe LA4 5AF notifying each of the above which licensable activity or activities will be taking place on which date and in which area or areas of the park and during which part of the licensable hours.  No notification requirement will arise in respect of any licensable activity or activities taking place in the Ashton Memorial or the Pavilion Café or their respective curtilages.

   

  2.              A Personal Licence Holder will be present at any outdoor bar located within Williamson Park of which Notice has been given and for the period during which such bar is open for the sale of alcohol.

   

  3.              The licensable hours for all licensable activities for the Pavilion Café and the Ashton Memorial will be from 10.00 hours to 12 midnight.

   

  4.              The licensable hours for any outdoor areas within the area edged red on plan number 9046/001 will be from 10.00 hours to 23.00 hours.

   

  5.              The maximum opening times for the Ashton Memorial and the Pavilion Café will be from 10.00 hours to 01.00 hours.  There is open pedestrian access to Williamson Park at all times and therefore the open areas are open to the public at all times but under the terms of the Premises Licence the licensable activities within the outdoor or open areas ie excluding the Ashton Memorial and its cartilage and the Pavilion Café and its cartilage will terminate at 23.00 hours.

   

  6.              In relation to the Sale of Alcohol, any person who looks or appears to be under the age of 18 shall be asked to provide identification that they are over the age of 18.  The following are the only forms of identification acceptable:  UK photo driving licence, Passport, Pass card (proof of age Standards Scheme) expect under the provisions of Section 149(5) Licensing Act 2003.

  
  Public safety

  The applicant will seek to agree reasonable conditions with the responsible authorities.

   

  The prevention of public nuisance

  The applicant will seek to agree reasonable conditions with the responsible authorities.

   

  The protection of children from harm

  There are no activities which will take place in the park so far as is known to the Premises Licence Holder which will cause harm to children.
